The court held in an opinion written by Chief Justice Bean that it was not necessary for George R. Funk, auditor of the city of Portland, to refer to the voters there an ordinance authorizing purchase of certain property on Front street as a public market. The opinion affirmed the decree of Judge Arlie O. Walker who is sued an order dismissing the al ternative writ of mandamus. The ordinance was attacked by Walter W. - Whltbeck on the ground that the emergency clause attached thereto was Invalid for the reason that the ordinance is a "franchise ordinance" and there fore could not become effective under the Portland city charter until the expiration of 10 days after its passage.
