Loser in Action Which
Drew Much Interest
The state supreme court. In an
opinion -written by Chief Justice
Bean, yesterday affirmed the de
cree of the circuit court for Mar
lorn county In a salt- brought by
W. A. - Kotthof f of Jefferson, to
' recover damages of $5000 from
tae Portland Seed company. Judge
Kelly of Marion county held for
tao plaintiff.
The, suit had Its origin In
If arch, 1926, when J. E." Parrisb,
a farmer and sheep raiser near
Jefferson, purchased 275 sacks of.
Rosen rye and other seeds from
Kotthoff, who was engaged in the
seed business in Marion county.
Parrisb. alleged that the seed was
net Rosen rye. but ordinary rye.
and later sued Kotthoff for dam
ages. He was awarded a Judgment
of 15000. Kotthoff then sued the
Portland Seed company; on the
grounds that the seed was not as
represented. .

The building fund committee at
the Y. M. C. A. yesterday went
oyer returns from letters recently
sent out asking for payment - on
the pledges which were made In
1424. The committee was disap
pointed -.at the small amount of
motfey paid on the pledges which
total more than 123.000. Collec
tion of the pledges Is urgently de
sired by the "Y" to allow repay
ment of a loan made with the new
building as security. Interest
charges amount to $200 a month
and must be paid from the gener
al budget of the association. . .
