the trial. ,
The case was declared by District-Attorney
Carson to be the
first of It kind in Marion 011017.
"No human life was ever snuffed
out under more criminal eircum
fetancea than was the life of Mayn-
ard Sawyer on Jnly 19," Carson
told the Jury.': , ' -
: Collier went over most of the
testimony that had been given on
both sides ia the trial,, repeatedly
pointing out instances which he
said showed' fatal weaknesses in
the state's : case." - That she .had

lie called the Jury's attention to
the fact, which appeared from the
testimony, that - Mrs. ;, Lockwood
had dxivn past, two . police offic
ers without being .stopped. "How
can they claim that she was driv
ing; so recklessly and so much be
yond the speed limit, when they
did not , even try to stop her an
I til after they had found that the
accident occurred?" Collier asked.
Again and again he pointed out
alleged-defects in the state's tes
timony. Some claimed to" . have
seen much more than could pos
sibly have been seen, he said, de
claring that one witness had been
able to give an exact description
of the car, of Sawyer and of the
accident when his view was, y
his 'own - admission,' confined ' to
what he could see by looking un
der another auto.' ". ; . .
, wouier maae a few allusions to;
the defendant's status as a wom
an "who work upon that ranch
from sun to; sun."
In reply to Collier's sUtement
that most of the state's witnesses
were young people, Carson declar
ed " that: the district attorney's of
fice had obtained whatsoever wit
nesses were available, and if there
had been any that were better and
more mature the defense had am
ple opportunity to procure them.
. r Lyle Page, deputy district . at
torney, made the first argument
for the state; and attacked the tes
timony of Chapman ' as made on
the previous . afternoon;' and
around whose statements the de
fense had built up the theory that
Sawyer was ' manicuring his fin
ger nails with a pocket knife at
the time he was struck and killed.
"Nobody saw him there at all,"
said Page. " ' v
When Collier made his speech
re retorted that the same thing
was true f of ; a number of the
state's witnesses.. - - . ,
In his Instructions-to the Jury
Judge Percy, R. Kelly stated that
It ras no defense In that particu
lar kind of a ease to show that
Sawyer was negligent, untoas his
negligence- was the entire . canse
of his death. 'In other words,' con
tributory negligence Is no' defense
in this case." "
