lawful "to teach any theory that
denies the story of divine creation
as taught in the Bible and to
teach Instead, that man has des
cended from a lower order of ani
mals." I The exchange between Darrow
and Stewart continued for a few
moments '.with the Judge taking;
j no part. Eventually It shifted to
a discussion or tne proper memoa
of getting the testimony of the
scientists into the record of the
case, j Defense counsel submitted
that witnesses should be heard in
the presence of court and absence
of the Jury. !
The attorney general submitted
that sufficient testimony should
be permitted in the record to en
able the supreme! court to pass
upon the proposition, but argued
that no long drawn-out examina
tion could be conducted, "and
make a farce of your honor's opin
ion." i
Arthur G. Hayes said that the
defense should have the right to
argue before the court that the
law is unreasonable. 1
i The attorney general suggested
that the excluded evidence be put
in substance, Darrow replying he
was willing to do that.
! W.' J. Bryan entered the dis
cussion. asking the court if the
witnesses were permitted to testi
fy as- experts for the InformatTon
of the courts if they would be sub
ject to cross examination. Judge
Ranlxton replied that the state
wool') b rfven the oiortnnlty to
cross-examine If the witnesses
went on the stand.
This drew a statement from Mr.
Darrow that the state had no snch
right. Finally the court ' ruled
that the defense might put its tes
timony In the form of affidaTits,'
but if witnesses were . U8ed they
would be cross-examined, r Then
we will make statements of what
we expect to prove," said Darrow.
"Can wd have the rest of the day
to draft them?"
! As I Judge Raulston seemed
about to demur, Mr. Darrow jcon
tinned:
) "If yonr honor takes half a day
to write an opinion " the judge
Interrupted, but the defense conn
sel spoke op again: .
i "We want to make statements
here of what we expct to prove
I do 'not understand why every
request of the prosecution should
meet with endless time, and a bare
suggestion of anything that is per
fectly proper on our side should
be Immediately overruled."
i "I hope you do not mean to re
flect upon the court, said the
Judge. : '
! "Well, your honor has the right
to hope," said Darrow.
. "I have a right to do something
else. perhaps." suggested the
judge.

FIRE EQUIPMENT ASKED
LIOXS VOTI1 TO KITTORT prn.
rHASK O: MATKRIAIi)
At the weekly rac-ting of the '
Lions club yesterday noon the or- -ganltation
voted nnanimously to-
support any campaign started for -
the purpose of securing adequate)
rire equipment to enable the fire
department to meet all emergen
cies that may arise. The organi
sation included In the above reso
lution a commendation of the
work dor.e by the fire department
during the fire last' Sunday night.
Frank Neer. district governor of
the Lions club, who has returned '
from the international Lions' con
vention at Cedar Point. Ohio, gave
a report of the convention. The
convention next year is to be held
at Ran Francisco. A keen rivalry .
between Los Angeles and Ran
Francisco delegates sprang up on
the train on the way east, and was
derided only after a caucus was
helJ on the train and delegates
from the two rival cities made to
see how futile would be -the at
tempt of either city to gain the
convention.
The work of the Lions' club, as
shown at the convention, was out
lined by Mr. Xeer. who also stated
that the club was a very active
factor in a movement to rid the
country of the many obscene mar
azlnes and books that are beln
published of late. According to
Mr. N'eer there have been IX mag-,
axlnea i that "out-French the
French." published for the f irt ,
time, daring the last six months'
in the. United States. In one or
two instances the Lions have tak
en it upon themselves to arreet
distributors of this obscene) liter
ature on charres of contributing
