PATENT PAVING'CASEr
SETTLEMENT IS MADE
( Continued from page 1)
has been saved by .reason1 of the
open competitive bidding which
has resulted from this contest- in
the letting of paving contracts by
the state and the various munici
palities. ' -,.v . i.
' The attorney general points out
that the courts have . uniformly
held that the state when it gos j
into court stands on the same foot-
ing as a private individual and,
the court having . held that the
state is liable on the contract,' it
is .Incumbent . upon . the state . the
same as an individual to settle, its
debt, .end in doing so it ts entitled
to settle with its creditor upon the
best terms attainable, - It is fur
ther pointed -out- that there is no
object or advantage to be gained
by a continuation of this litigation
other than a possible reduction ot
the amount to.be finally paid. at
the risk of being required to pay
a ' greatly increased amount- be
cause,, the paving patent in Ques
tion having expired, there is no
question of . its validity, or other
question of public right, to be set
tled by such litigation, and alto
gether . it ... seems . the exercise of
sound discretion to - save further
expense of . litigationand make a
favorable: settlement now.
BETTER THIS YEAR

. In .speaking of the class of peo
ple stopping, at .the I Salem auto
camp this year, H." S. Poisal re-i
marked yesterday that It is very
much better than' it has been In
previous years, u There seem to be
fewer tramp tourists, Mr. Poisal
stated, and gave as the probable
reason that this year the rate has
been raised to 50 cents a night
straight, instead of 50 cents the
first night and 25 cents each night
there after, as it has been ln for
mer years., ' ,:" . . .-.
, The number of tourists while
not much more than halt as large
ss the .number registered last
year at this time Is Increasing
rapidly. The last few days have
seen .cars registered from many
eastern states ' and it is expected
that the number will continue to
grow each 'day. throughout the re
mainder- of-the summer although
It probably v will. not .reach last
year s ligure. uiner. reasons .ox-r
fered for the scarcity of. tourists
in Salem' this year are that the
tourists are being j, directed - to
take , the , west .highway, thus
avoiding Salem, .and that the
highway is closed for repairs be
tween Junction City, and Harris
y Salem business men are awak
ening to., the ..truth ; of what , it
means to lose all ot this tourist
trade and signs encouraging . and
directing the tourist j toward Sa
lem are being erected . at many
places along the highway.

German Infant Mortality
Reduced to Half Since War
BERLIN Statistics recently pub
lished show that the mortality
among infants is much less than
in pre-war days. .During the third
quarter of last year - the death
rate was only about one-half the
percentage during the year Just
prior to the World war.
' The medical authorities at
tribute this improved condition to
the cold weatheT during the latter
part of 1924, which they state is
always more beneficial than warm
weather for Infants during their
first year. -.
