Mandamus Demands Vote
' On Justices in Group
With Dr. C. J. Smith of Port
land, chairman of the democratic
state central committee, iiamed as
plaintiff, a mandamus suit was
filed In the supremb court yester
day against. Sam; A Koser, seere?
tary of state, demanding thai : the
names of the three lcahdidates",for
the supreme bench Jto be voted on
in the November election be- en
tered on the ballot in a single
group.,, . ' 1 I I ' -,
On the ballot as certified, by
Secretary of State Jvoier, Justice
Coshow and Judge H. III. Belt of
Dallas appear as Uie democratic
and the republican candidates re
spectively to succeed Justice Law
rence T. Harris, who resigned.
Justice Coshow was; appointed to
the office by the -governor, bit
under the law serve only through
the approaching election. ", The
Ijiame of Judge Pery K. Kelly of
Albany;. appears on. the ballot as
an Independent candidate to suc
ceed the late Justice 'John Mc
CourU Judge Kelly is a republi
can, but Is running independently
because; the death' of Justice Mc
Court occurred too late to make- it
possible for candidates to file with
party designation.
It is the opinion of the peti
tioners for the' mandamus that
with the three names grouped,
and with instructions for the vot
ers to vote for two. Justice Coshow
will have a better chance of elec
tion thanvhe. will with only Judge
Belt as his opponent.
