WASHINGTON. Aug. 2. With
the organization of the new Board
of Tax Appeals, which, takes out
side of the treasury the final de
cision in disputed tax cases, the
bureau of i internal revenue has
net up a new code of regulations
governing procedure ; in the hand
ling of caoes before appeal is tak
en to the high tax court. This
procedure includes the creation of
a new com mil tee on review wttn-
in the office of the solicitor of
internal revenue, a body largely
supplanting the old unofficial
committees on appeal that func
tioned prior to enactment of the
last revenue law. '
The regulations' provide that in
every case where a deficiency apr
peai s to exist, the interna reve
nue bureau willgive the taxpayer
notice of 30 days ao that. If he
iesires, he may file a protest, re
quest a hearing and offer evidence
against the proposed increase.
The letter of protest should; con
tain the. name and addrera of the
taxpayer, name andi place, of busi
ness of the corporation and the
state in which it was incorporat
ed, a designation of the year of
years involved, a statement of the
amount of tax in dispute, an item
ized schedule of the bureau's find
ings to which exception has been
taken and a summary of state,
ments of the grounds upon which
the taxpayer relies in connection
with each . exception to the find
ings. - "
If the taxpayer presents no pro
test" within 30 days of his notifi
cation, final determination will be
made 'and - the taxpayer so noti
fied. The taxpayer then, under
the new law, may appeal the case
to the board of tax appeals,' take
it out of the hands, of the bureau
of internal revenue entirely and
go into thet open with his argu
ment and evidence, for the tax
law provides that all hearings be
fore the tax appeals board : must
be public and a written record of
the proceedings made if the
amount exceeds $10,000.
Appeal to the board of appeals
must be made within 60 days
after the taxpayer has received
notice from the internal revenue
commissioner that a final deter
mination has been made. Acconn
panying the notice of a final de
termination will be a form of
agreement consenting to the as
sessment and if the taxpayer de
cides to drop his contention, he
may execute the form and return
it to the bureau, thus closing the
case. :
Ln working out this arranger
ment, it is the hope of the; treas
ury to eliminate a. vast amount of
work that otherwise would go to
the tax board and jam its docket.
In other words, the treasury. Act
ing Secretary Wington said,' hope
ta reach a settlement with every
taxpayer possible ; and serve the
double purpose of getting such
revenue as is due into the Trea
sury at once ancj reducing the
number of cases lo ke heard be
fore the Board of Tax Appeal?.
Before entering the Treasury
Mr. Winston was associated with
a Chicago law firm and his exper
ience there, he said, convinet-d him
that the average taxpayer wa3
concerned more with an early and
final settlement of a tax; claim
than with-the amounts, excepi of
