Investment Company Files Cross Complaint in Court i i -- - . ! " ? ' . An answer and cross-complaint to the complaint of 'the board of foreign missions of the Methodist Episcopal church against the Ore gon Realty Exchange Investment company and John L. and Mrs. John L. White, was filed in the circuit court yesterday by the do f endant Oregon Realty Exchange Investment company. t On March 26, 1921, the answer asserts, the plaintiff conveyed title to two lots In University ad dition to the Oregon Realty com pany and In April, 1921, that com pany gave a mortgage for $1500 as security. In May 192 2, -how ever, the realty company, in an agreement, with the defendants, John L. and Mrs. John L. White, conveyed title to the property .to the latter, receiving in return 129 acres of land in Linn county, sub ject to a '$1500 mortgage. The Whites are also understood I. to have received a one-half Interest in the bath house located in the Oregon bunding under , A. r C, Hutchins... ! - ' j t ; I -,': -. 3,' t ' In June. 1922, suit was brought by the Whites against the Oregon Realty company on the grounds that representations made as to property . . conveyed were, false. When the case came up before Judge George Bingham in circuit court, however, it was dismissed. with the result that the contract stood as before. ' 5 J . s The Oregon Realty company now states that the White's refuse to surrender the property and al so refuse to take possession while the realty company has abandoned the property. v i . The Oregon Realty Exchange Investment company asks that the plaintiff have, judgment against the -company and the Whites for $1500, the extent of the mortgage. with 6 per cent interest from April 1921, as well as $100 attorney's fees. - In addition it asks, that White s be, ordered Ho surrender possession of the 120 acres In Linn .county to the defendant.'
