Question Relative to Levying
of Taxes by Districts
Is Explained
Procedure to be followed in ad-
misistering an act of the 1921
eglslatnre known as the "local
budget law" is explained to Percy
A. Cupper, state engineer, in an
opinion by Attorney General Van
Winkle, as it relates to the levying
of taxes by irrigation districts.
There is no apparent conflict
according to the opinion, between
the act and the irrigation district
law previously enacted requirng
a budget to be prepared on or be
fore first Tuesday in September
and to be opened for discussion
before an equalization board on
the first Tuesday of the following
October.
"The essential requirements of
the local budget law," said Mr
Cupper after reading the opinion.
"are the preparation by a budget
committee consisting of a number
of legal voters and freeholders or
the district, of a budget fully item
lzed, the proper' publication of
the same, the molding of a tax
payers meeting to discuss the bud
get, and a levy ot the taxes by the
board of equalization.
"Mr. van Winkle holds that in
view of the fact that the new act
specifies no particular time at
which the required duties are to
be performed, there is no reason
why the provisions of the old act
specifying the time should not be
compiled with, as there Is suffi
cient time between the date of the
preparation of the budget and the
discussion by the taxpayer for the
publication or posting required by
the new act, ;
