Dr. Potts appeared before Judge Unruh yesterday and cleared up a recent "no funds" check charge which had been filed against the doc tor. According to his own version of the affair. Dr. Pelts had given a 15 check to a R. L. oung who de layed in presenting the check to the bank' at Falls City. In the mean time Dr. Potts moved to another town and transferred his funds to a bank there , not knowing that the check had not been presented. After Dr. Potts proved that he had avail able funds in the second bank he was released by Judge Unruh. The defendant in his answer denies the plaintiff's allega tion that he ' is an unfit person to have care and custody of the minor daughter of the couple, and further denies that he earns good wages, stat ing that his share of the receipts as a partner in a butcher shop in Turner does not exceed $60 a. month. The defendant seems inclined to allow the mother custody of the child but as serts his willingness to contribute a sum commensurate with his earnings to support the little girl.
