Since Witnesses Fail to
Agree on Course -
When something like 17 witnesses
swore in court that the ' original
course of a stream was across one
field and about 18 testified that it
was across another. Circuit Judge
G. G. Bingham decided yesterday to
don his rubber boots and make a trip
to a point east of Silverton himself
and personally investigate the sit
uation. For nearly two days the
court has been hearing the suit of
Fred M. Reardon versus J. F. Daws,
involving water rights on property
20 miles east of Salem, but the wit
nesses on both sides have consistent
ly contradicted each other.
The plaintiff is the owner of an L
shaped piece of property, across the
road from which are two springs-
streams ; from which take
course through land belonging to
Daws, and another farmer. Recently
a ditch has been put along the upper
edge of the defendant's land with the
result that the water from one sprint
Is diverted into a field belonging to
Reardon and has practically ruined
it. Daws maintained that the water
before the construction of the road
always went across uearuon s pro
perty, while the latter's witnesses
say It should follow the course of
the water from the second spring
which runs through Daws' land. Nel-
her side had secured the services o'
surveyor in ascertaining the true
lay of the ground.
The foreclosure suit of J. t. Mor
ris against the Gates Lumber com
pany was taken up yesterday and
will be concluded probably " this
morning. This involves the foreclos
ure liens or 18 loggers. The divorce
case of Woolery versus Woolery Is
also on today's calendar.

tion of lumber carrying vessels was
