A bill to aid in the construction
of a steamboat canal and locks
at the Wilamette Falls .at Oregon
city, in the Willamette river,
and to appropriate funds there
for. Wiikreas, The People's Trans
portation Company is a corpora
tion duly incorporated under the
general incorporation laws of the
State of Oregon, for the purpose
of transporting freight and passen
gers on the waters of the Willam
ette" and Columbia rivers, and their
tributaries, and all necessary port
ages; and whereas,
It is of great importance to the
people of Oregon that the obstruc
tion to the free navigation of the
Willamette, river at the Falls of
the same at Oregon City be re
moved, and the transportation of
passengers and freight greatly fa
cilitated ; therefore,
Be it enacted by the Legislative
Assembly of the State of Oregon.
SiX'Tiox 1. That the State of
Oregon hereby pledges its faith to
pay to the said People's Transpor
tation Company aforesaid, the sum
one hundred and twenty-live thou
sand dollars in gold coin, as here
inafter set forth, out of the funds
donated by the United States to
the State of Oregon for the pur
poses of internal improvements.
Sec. 2. In order to entitle the
said corporation to receive the
sum of money hereby agreed to be
paid, it shall be the duty of said
corporation to construct a canal,
locks or works on the cast side of
the Willamette river at' Oregon
City, either with inclined planes,
or oincrwise, at tno discretion ot
such corporation, provided said
locks shall be not less than one
hundred and eighty feet in length
and thirty live feet' in width, and
to be constructed of stone, cement,
iron .and wood, and built in .a dur
able and permanent manner. Such
canal, locks or works, whether on
the inclined plane system or other
wise, to he suhicient to pass boats
to and fiom the Upper and Lower
Willamette river, and after the
completion of the same, the said
corporation sliali'pass without de-
lav through said canal locks or
work, all steamboats, flat boats or
other water craft, in the order in
which they shall arrive at either
terminus of said works.
Sec. The State of Oregon
agrees to pay the said sum of mon-
, upon the express condition
that the said corporation, after the
completion of the said canal and
locks, or inclined plane, as herein
before set forth, shall not, for a
period of ten years after the same
is completed, charge a greater rate
of tolls than twenty cents per ton,
registered tonnage, lor each steam
boat or other water craft going
through said canal, locks or works;
and after the expiration of ten
years, the said corporation shall
not charge a greater rate of tolls
than fifteen cents per ton registered
tonnage for each steamboat or oth
er water craft going through said
canal, locks or works; and at the
expiration of twenty years from
the time said canal, tocks or works
are completed, the St.ate of Oregon
shall have the privilege to take and
appropriate to its own use forever
the said canal, locks or works, up
on the payment to the said corpo
ration the actual value thereot at
the time of taking and appropria
ting the same, winch value shall be
ascertained in such manner as the
Legislative Assembly of Oregon
may hereafter prescribe.
Sec. 4. 1 he aid hereinbefore
provided shall be paid to said cor
poration in the manner as follows:
When said corporation shall ex
pend the sum of twenty thousand
dollars toward the construction of
said canal, locks or works, then the
State shall pay to said corporation
fifty per cent of the amount ex
pended, shall be paid annually,
provided that the aid furnished by
the State shall, in no one year, ex
ceed the sum of thirty thousand
dollars; and the said several sums
of money shall be paid out of the
fund arising from the five per cent,
of the net" proceeds of the sales
of the public lands of the United
States lying within this State; or,
in case' the same sh.all be insuffi
cient to pay the said sums as they
become due, then the same shall
be paid out of the interest on the
fund arising out of the sale of the
five hundred thousand acres of
land donated to the State of Ore
gon for the purposes of interna-

improvements by the act of Con
gress, entitled "An act to approl
priate the proceeds of the sales of
the public Lands, and to grant pre
emption rights," approved Sept.
4, 1841 ; or, in case the interest on
the said fund shall be insunicient
to pay the said sums of money
specified in this Act, then the same
shall be paid in part out of the
principal of the said fund; and in
the event that there should be in
sufficient money in any of the
funds aforesaid to meet any such
amount when the same is due, then
warrants shall be issued for such
amount by the Secretary of State
in favor ot said corporation, which
warrant shall be drawn on the
State Treasury, and shall bear in
terest from date of presentation
to the State Treasurer, at the rate
of ten per cent, per annum in gold
coin.
Sec. 5. The faith of the State
of Oregon is hereby pledged for
the payment of the sums of money
to the said corporation, as herein
before set forth in this Act, on the
express condition that the said
corporation shall construct the said
canal, locks or works, in the man
ner nereinbeiore provided, and
shall not charge a greater rate of
tolls than is herein set forth ; and
it is further provided, that the pay
ment of said several sums of
money shall be made upon the ex
press condition that the said cor
poration shalll pay to the State of
Oregon five per cent, of the net
profits arising from tolls collected
for passing steamboats and other
water craft through said canal,
locks or works, for the period of
twenty years from the time of the
completion of said works.
Sec, 0. The said corporation,
to entitle it to the benefits of this
Act, shall commence- the construc
tion of said canal, locks or works,
on or before June 1, 1871, and
within one year from that date, ex
pend the sum of twenty thousand
dollars toward the construction
thereof; .and within two years from
said date, shall expend the fur
ther sum of twenty thousand dol
lars and the whole of said work
shall be completed and ready for
the passage of steamboats or other
water cratt,within three years irom
the commencement thereof; and if
any of the conditions or require
ments in this section set forth shall
not be fulfilled in good faith, all
privileges, immunities and
aid herein granted said company
shall be forfeited to the State.
Sec. 7. "There shall be appoint
ed by the Govcrncr of the State
three disinterested persons, whose
duty it shall be to examine said
work each year; .also, the books,
receipts and expenditures made on
account thereof by said corpora
tion, and report to the Governor
in writing and if it shall appear
that the said corporation have
complied with the requirements of
section G of this Act, then the Sec
retary of State shall draw his war
rant "on the Treasury in favor of
said company for the amount found
due; and if said conditions are
complied with, it shall be the duty
of the Governor immediately to
declare by proclamation all the
rights, privileges and aid herein
granted' to be forfeited to the
State.
Sec. 8. The words canal, locks
or works in this Act, whenever
used, shall be held to include and
mean works of any description,
whether inclined planes or other
sufficient structure whereby boats
of the description aforesaid may be
passed through np and down.
Sec. 9. Said corporation shall
signify their acceptance of the
provisions of this Act by written
notice to the Governor, under the
corporate seal of said corporation ;
and upon filing such acceptance,
the Governor shall require of said
corporation bonds in the penal sum
of two hundred and fifty thousand
dollars, United States coin, condi
tioned: that the works herein pro
vided for shall be commenced,
completed and kept in repair; and
all moneys due the State oy virtue
of the- provisions of section 5 of
this Act be paid into the Treasury
quarterly; and upon any failure in
whole or in part of said corpora
tion to comply with the provisions
of this Act, such corporation shall
forfeit to the State all rights, priv
ileges and immunities conferred by
this Act and in such event, shall
refund to the State all moneys re
ceived by virtue thereof, together
with ten per cent, interest thereon
from time of receiving the same.

Hon. B. II. Burch, of Polk, in
troduced the following bill in the
Senate, en the 20th inst :
To amend an Act entitled "An
act to appropopriate funds for
the construction of a Steam
Boat Canal at the Willamette
Falls." Approved October 20,

no:- 1. That "section 2"
of said act bo amended to read
as folllows:
In order to entitle the said cor
poration to receive the sum of
money hereby agreed to be paid,
it shall bo the duty of the said
corporation to construct a Canal
and Locks at and on the west side
of the Willamette Falls. The
said Locks to be not less than one
hundred and sixty feet in length
and forty feet in width, and to be
constructed chiefly of stone, ce
ment and iron, and otherwise built
in .a durable and permanent man
ner. The said Canal and Locks to
be Completed on or before January
1st, 1873. And after the comple
tion of the same, the said corpo
ration shall pass without delay
thorough said Canal and Locks, ail
steamboats, flat boats, barges and
other water crait, m the
order
m
which they shall arrive at either
terminus of said Canal.
Sec. 2. That "sect ion 4" of said
act, 'be amended to read as follows :
That within ninety days after
the approval of this Act, the "Wil
lamett Falls Canal and Lock Com
pany" shall execute and deliver to
the Secretary of State,. a good and
sufficient bond with sureties paya
ble to the stiite of Oregon in the
sum of three hundred thousand
dollars. Said bond to be approved
by the Governor of this State;
conditioned, That said Company
shall on or before the first day of
January, 1873, construct and com
plete said Canal and Locks in ac
cordance with the provisions of
this Act. when the Governor and
Secretary of State shall issue and
deliver "to the said Willamette
Falls Canal and Lock Company,
gold bonds of the Statoof Oregon,
for the sum of two hundred thou
sand dollars in bonds of five hun
dred dollars each, payable to said
Canal and Lock Company, or its
legal assigns in ten years or sooner,
at the option of the State, bearing
interest at the rate of seven per
cent, per annum, payable semi
annually in gold. Principal and
interest of said bonds shall be
paid out of the funds arising from
the five per cent, of the net pro
ceeds of the sale of public lands
of the United States lying within
this State, or out of the sale of the
five hundred thousand acres of
land donated to the State of Ore
gon bv act of Congress for the
purpose of internal improvement,
or from both of said funds.
Sec. 3. That "section 5" of:
said Act be amended to read as
follows :
The faith of the State of Oregon
i hereby pledged for the payment
of said bonds by this Act author
ized to be issued, upon the express
condition that said corporation
sffall construct said Canal and
Locks in the manner before pro
vided in this Act, and not charge
a greater rate of tolls than is here
in set forth. And it is further
provided that the issuance and pay
ment of said bonds shalMe made
upon the express condition, that
said corporation shall pay to the
State ot Oregon ten per cent, oi
the net profits arising from the
tolls collected for passing freight
and passengers through said Canal
and Locks for the period of ten
vears from the time of the comple
tion' thereof, and five per cent, of
said net profits, after the expira
tion of said period of ten years.
Sec. 4. That "sectjon 7" of
said Act be amended to read as
follows:
The said Canal and Lock Com
pany shall 1)0 required to fully
complete said Canal and Locks
acording to the requirements of
this Act, on or before the first day
ef January 1873. And if the
above condition is not complied
with, the bond required by this
Act to be given by said company
to the Stjite of Oregon shall be
deemed to be forfeited and broken,
and all the rights given said com
pany by the State under this Act,
shall be deemed forfeited.
Sec. 5. That "section 8" of
said Act be amended, to read as
follows :
On the completion of said Canal
and Locks, the Governor shall ap
point three Commissioners to ex
amine the works and report there
on, and if from the report of the

Commissioners, of a majority of
the commissioners, of a majority
of them, the works are completed
as hereinbefore specified, then said
company shall be discharged from
any liability on its bond executed
to the State.
. Sec. G. The act to which this
is amendatory is hereby continued
in force the same as if all the re
quirements therein had been fully
complied with by the said Willam
ette r ads Canal and Lock Com
pany.
