    WEBSTEll'S ItETAISiNO FEB.
" S. C, Jr." sends the following
anecdote of Daniel Webster to the
New York Ledger:
One day a gentleman from New
Bedford waited upon Mr. Webster,
'. in his ofhee on Court street, wish
ing to engage him for the defense
in an important ease at law. The
visitor was himself the defendant,
."and, the amount at stake in the
fmit was from sixty to seventy
thousand dollars. He presented
all of, the important points, and
Mr. "Webster was willing to under
take the task. 13 tit the client could
Hot tell exactly when the case
would come on.
" Very well," said Mr. Webster,
" if you wish to retain me for the
defense in this suit, I will hold my-
seli m readiness, and will not en
gage for the plaintiff."
The gentleman asked what the
retaining fee would be.
v '.'A thousand dollars."
' A thousand dollars!"
" See what I engage to do, sir.
I not only hold myself at your
command, perhaps - for a month or
more, but 1 debar mvsell Irom ac-
ccpting any offer, no matter how
large, from the plaintiff."
The applicant filled out a check
for one thousand dollars, and gave
it to the great expounder.
' " Aiul now, sir," said Daniel, af
ter he had put the chock in his
pocket, " I will give you a bit of
advice, gratis. It you can com
promise this business upon fair
terms with the plaintiff, you had
better do so."
The client acknowledged his
, , . -i t .. i
thanks, and then took m iraic
Daniel sent the check to the bant,
where it was duly honored.
On the very next day the gen
tleman from New Bedford called
upon Mr. Webster again. The
2laiutiff was in Boston had come
up on the previous day on purpose
to compromise and a compromise
had been effected.
" In short," said the client, " we
have made a fair and satisfactory
settlement."
Mr. Webster was very glad; and
having so expressed himself, and
duly congratulated his visitor, he
would 'have turned to other busi
ness, but the visitor seemed to have
something further on his mind
something that made him restive
and uneasy.
': Of course," lie ventured, after
a pause. " 1 shall not require your
services, Mr, "Webster."
" Certainly not,o sir."
"And and how about the one
thousand dollars I paid you ?"
faintly queried the gentleman, who
couldn't see the propriety of pay
ing such a sum tor services which
were never to be rendered.
" O, ah," responded Daniel, with
bland smile, " you don't seem to
understand. It is very simple.
That was a retaining fee, called, in
law, a retainer. By virtue of the
contract I, also beceme a retainer.
What should I retain, if not my
i. V .
And the gentleman from New
Bedford went away thoroughly
instructed in the legal signification
of a retainer.

Mercury of October 6th seys :
' On Monday evening Daniel Deves,
J r., aged about eighteen years, who re
sides with his parents near Los Gatos, in
this county, while standing leaning upon
a loaded gun with both hands resting
across the muzzle, hit the hammer acci
dentally with one of his feet, discharging
the contents of the gun through both of
his hands. A physician was called, who
found it necessary to amputate the left
hand at the wrist, and also to remove a
portion of the right hand. The latter will
probably be saved, although in a badly
crippled condition'

THE COXDITIO-Y OF TISX.VS.
It is difficult for persons living at the
North to conceive the harassment which
are the daily lot of the people of Texas,
and the state of uncertainty, which is the
worst of despotisms, under which they
live. The military government that af
flicts the Southern States is worse in Tex
as than anywhere ehe. An " old Repub
lican," one of the pioneers of Kansas, now
living in Texas, tells us something about
the troubles of the people, in a letter to
the Cincinnati Commercial ; Every ver
tige of civil law," he says,"is blotted out;
trial by jury a nullity ; the writ of habeas
corpus suspended ; all civil officers subject
to removal by the military ; the whole
State under the control of a military dic
tator, whose word is law. Blaekstone,
I Kent, Coke and all the learned commenta-
tors are ignored. The Judge examines
only military orders. The military are
not the conservators of peace, but of an
archy. The worst state of society in Tex
as we find around the military headquar
ters." Some times people ask : How long
will these things exist? The answer is.
till the authors of them shall be removed
from power. St. Louis Republican.

THE LOCAL PAPER.
o The following tribute to the local paper
from the Chicago Republican;, contains so
much truth that we transfer it to our col
umns and commend it to the careful con
sideration ofour business men and those
interested in our town:
'"What tells as readily the standard of
a town or city as the appearance of its
paper ? And its youth or its age can as
well be determined by the observing as
by a personol notice. The enterprise "of
its citizens is depicted by its advertise
ments, their liberality by the looks of the
paper. Some papers sjiow a good, solid,
healthy foundation, plethoric purses, and
a well to do appearance generally; others
show a striving to contend with the grasp
ing thousands around them, trying hard
to wrench out an existence from the close
fisted community around them- An occa
sional meteoric display in its columus of
editorials, show what it can o if it had
the means, but it cannot continue in the
expensive work until support comes,
which ought1 to be readily granted. A
newspaper is like a church; it wants fos
tering in the commencement and for a
few years then a.- a general thing it can
work alone and refleot credit upon Its lo
cation. Take your home paper, it gives
you niDre news of immediate interest than
New York or other papers ; it talks for
you when ether localities belie you, it
stands up for your rights; you always
hove a champion in your home paper,
and those who stand up for you should
certainly be sustained; your interests are
kindred and equal, and you must rise or
fall together. Therefore it is to your in
terest to support your home paper; not
grudgingly, but in a liberal spirit; as a
pleasure, not as a disagreeable duty, but
as an investment that will amply pay the
expenditure."

The Young Men's Caristian Asso

furnished stamps for our Postmas

be dropped into the Post. Office
without stamps. On Monday a
young lady appeared at the Post
Office in a state of more than or
dinary excitement. It seems, she
had addressed a letter to a young
gent who lives in some of the low
er counties, forgetting to pay the
postage. Our P. 31. availing him
self of the stamps and -printed slips
of the Y. M. C. A., sent the letter
on its way rejoicing. Its owner
received it in due time, but could
not comprehend, why the Y. M. C.
A., should have anything to do
with, letters addressed to him. He
inquired of his lady correspondent
what it meant. She immediately
laid the matter before, our P. M.
and wanted to know in very de
cided language what business the
Young Men's Christian Associa

Our Postmaster" enlightened the
