Attention of the Council is directed to this

As there will be a meeting of the City
Council soon we invito attention to the
condition of the street and steps, near tbo
reservoir of the Water Works. There is a
big leak there, which needs to be stopped.
. Judge Upton has a pretty clear head.
He made some righteous rulings at this
term, concerning applications for divorces,
which we shall endeavor to obtain, for
publication.
Clackamas County has paid Cesser fc
Co., $150 00 for the right to use the Gard
ner Patent Shakel. It was necessary for
the safe keeping of prisoners and the
occasional transportation of a convict to
Salem. 1
The Herald and Commercial arc hop
ping mad about the situation " at Wash
ington respecting the 0. C. R. R. Of
course those journals are disinterested par
ties. Oh, yes!
A smaller transaction than contemptu
ously sending a few " dead head papers"
back to this office by the P. T. Company,
was attempted to be played upon the
Good Templars, who chartered the Saia
tor for a trip to Portland, last Thursday.
Comment is reserved.
We were in error last week in stating
that Mr. Barlow had the contract for fur
nishing the Hose carte and Hook and
Ladder Truck Tor the fire Department.
They will not only be made by Mr. David
Smith but upon a direct contract with
him. His shop affords facilities equal to
any for the construction of all orta of
vehicles even baby cabs.

The St. Paul Pioneer assures us that
work will be commenced upon the North-
?.-n Pacific Railroad this spring. Col. Wm.
Crooks, one of Minnesota moit indefati
gable workers has taken another large
contract on the St. Tan I and Pacific II. ll.,
which will lay that track out to the Wes
tern boundary of Minnesota.
We understand that a beast in human
form is running at large ia Clatsop couaty
on $4,000 bonds for his Appearance for a
crime worse than incest. We love "order,
and law but in the aof this man think
a charge of cold lead is deserving, and re
commend its application by the father of
one of those little girls.
The Grand Jury did cot report that
the cells of our old County Prison are
illy adapted to the purpose for which they
are used, nor that the County should begin
to lay up funds for the construction of a
new jail but they truthfully remark in
their report, that they found the imilding
"neat and well kept," although "not as
coracaodious and substantial ctraeture
us it ought s3 Ite."
The Editor of the Advooxte passed up
the Wallaraent 17 years ago, m the

these were discontinued from June until
the return f the raky season. Now there
is demand for daily trips for almost the

The importance to the people of Oregon,
of the work to be constructed by this com
pany, can scarcely be overestimated, and
we are glad to know that the prospects
for their early construction, are every day
becoming better The Wallamet river is
a life artery of this State, and must con
tinue, even after the construction of rail
roads, to occupy a very important relation
to the material interests of the people of
Oregon The great want of this "country
h cheap transportation. ' We have the soil,
climate, timber, minerals, and all the ma
terial resources of a great State and a pros
perous community. Yet we are in a great
measure shut out from the rich, markets of
the world, for the : simple reasStt that mo
nopolists and speculators have secured
our avenues of communication with the
outer world. - s "
We are not particularly surprised that
this is true, nor are we disposed to com
plain about it, knowiHg as we do that it i3
human nature to do as these speculators
have done, yet we feel that the days of
their domination are numbered, and that
the construction of the Locks on tho West
side of the river at this place will hasten
the day when Oregon, like a young giant,
will spring forth . renewed, regenerated
and disenthralled." We are not disposed
to under-rate the magnitude of the work3
already constructed by the People's Trans
portation Company, though the more in
telligent members of that Company know
they fall far short of answering the pur
poses for which they were intended; but
we do deprecate the spirit which actuates
them in attempting to cast odium upon
other men who are disposed to profit by
their experience.
The last Legislative Assembly, apprecia
ting the importance of removing obstruc
tions to the free navigation of this river,
passed an act appropriating one hundred
and fifty thousand dollars, out of funds do
nated to the State for the purpose of in
ternal improvements, as an inducement
to the construction of a canal and locks
around the falls; under this act a compa
ny has undertaken the work and the day
is not far distant when unobstructed nav
igation of the Wallamet, from its mouth to
the head of navigation, will forever pre
vent its control by one company. Here
tofore it has been madness to attempt to
sustain an opposition of boats on the river,
because the facilities of the P. T. Co. for
transporting freight over the falls have
given them an advantage, which enabled
them to carry freights at a rate that would
not pay an opposition line. This state of
things must continue until the canal and
locks are constructed, when the day of
high freights, and supercilious behavior,
will be at an end. In the mean time we
may expect that the project will be
frowned upon by the P. T. Co. and their
satelites, against whose domination it aims
a fatal blow. But the work will go on.
and our advice to the P. T. Co. is this:
Make hay while the sun shines;" put up
the price of freights, grind the face of the
poor, reward your friends, and punish
your enemies; and if other oppositions
should be put on, wateb touu stock and
buy them out. By this course you may
perhaps wring from the people enough to
enable you to leave the country, when
you can no longer make merchandise of
the people's necessities.

Suits for Right of Way,
Of the 21 suits for right of way com
menced by the Railroad Company in the
the term of court just ended, only one
came to a contested trial. In one case
where no defence was made, a jury was
empaneled to estimate the damaeK and
proper evidence submitted to them. Sev-

tober term, arc cases involving the rights
of minor heirs, which could not e-asily be
settled by any otiier course and have to
be continued to give all the parties a prop
er hearing. In the case of Judge A. E.
Wait who owns about 640 acres of land
on Baker's Prairie, known as the Beales
donation land claim, a determined contest
was made, the damages elaimed being
$1,200. This case occupied over two days.
The jury was, at the request of Judge
Wait, sent out to view the premises, a
large number of witnesses were examined,
and as the result a verdict was rendered
in favor of the defendant for fifty dollars
damages, which in view of the fact that
the Company had in writing tendered
Judge Wait one hundred dollars rather
than resort to litigation, may be consid
ered a decided triumph for the Company.
We believe the action of this jury is a
good index of the popular sentiment, that
tho building of railroads through Oregon
should not be hindered by factions, oppo
sition and personal desire for gain. '

The following are the laws of Congress
touching the liability of subscribers to
newspapers:
1. Subscribers who do not give express
notice to the contrary, are considered as
wishing to continue their subscription.
2. If subscribers who have not paid, or
der their papers stopped.the publisher may
continue to send them Until paid.
3. If subscribers refUse or neglect to take
their papers from the office, they are held
responsible until they settle the bill and
order the paper disontinued.
4. If subscribers, remove to another
place without informing the publishers,
and their papers are continued to the
former direction, they can be held re
sponsible. ,.
5. The Courts have decided that refusing
to take a paper from the office, or remov
ing and leavimr it uncalled for is rrrima

Railroad Item. While some men
are trucks to bear the burdens of the earth,
or furnace grates to bear the fires and to be
consumed in obscurity, others are driving
wheels which give Hfrand motion to all with
whom they are connected. Kohn & Fishel,
the leading dry goods merchants of Port
land are the driving wheels of trade in that
city. Tbey conceived and carried on to com
pletion a work nobler than the Pyramids,
grander than the gardens of Nineveh, or the
walls of Babylon ; for their work . is not a
monument for the dead, neither the gratifica
tion' of a luxuriant fauey, but it is a new
pathway for purchasers, a link to bind , the
chatu of families aad the hearts of men.

' The Gang Plow made by J. C. Pfeil.
Arenzville, Cass county Illinois, is received
with no little favor in the west. Almost in
credible stories are told of its excellence
and efficiency in plowing the prairie fields
of Illinois and other States.
" The depth of the furrow is regulated by
the crank-axle, which is so arranged that
the ploughs can be driven deeper or shal
lower at the pleasure of the driver, when the
team is moving,by means of the lever.
"We also manufacture sulkey plows for
small boys, or infirm persons who are unable
to manage a team of three or four horses.
This gang or sulkey plow, will cut a fur
row from 2 to 10 inches deep.
' The committee who tested the draught
of this plow with a dynamometer state, that
it ran lighter by 140 pounds,than other plows
when running at the same depth) ana held
by the plowman while on foot.'
