The ease With which divorces arc
obtained in many States of the union
has led to a general moveoienl to
wards securing some uniformity for
divorce procedurt throughout the
OOUDtry. The American Bar associa
tion bia had the matter under dis
cussion for several years and at its
recent session the commission on
uniform law? reported a plan which
it believed would prove generally
acceptable to those who think there
is need of reform in our divorce laws.
The commission recommended that
no divorce be granted in any state
unless the grounds for the suit were
valid in the state when the caU8
aro?e. Where the suit is brought in
the same state in which the cause
arose the person seeking the divorce
must have had on actual residence of
one year and must prove a bona fid(
intention of making the state his oi
lier permanent home. Where the
cause arose in an outside state ai
actual residence of two years is re
quired in the state in which the
divorce is sought.
In order that migratory divorce?
may be less common and that there
may be fewer scandals where divorces
are granted on short notice in distant
states while the other party may be
ignorant of what is going on, the
committee recommended tiiat no
person shall be entitled to a divorce
unless the defendant shall have been
served personally with a process: ex
cept that if the defendant'ean not !
found after a diligent search ot
months it shall be lawful for the
court to authorize publication of the
suit and grant a decree. After
divorce either party may marry, but
in cases where a decree has been
granted without the presence of
the defendant the divorce shall not
become operative until six months
after the decision.
It will probably be a good deal of
an undertaking to secure an such
reform as that outlined. Of course
the only practical way of doing it is
to sjet the several states to pass laws
embodying the requirements out
lined. But it would be no easy
matter to get all of the states to agree
to the same law. Many states,
presumably those where las divorce
law- prevail. miht object to any
change, and if there was a single state
which continued to grant divorces
"while you wait. the injustice,
wrongs and troubles which are said
to grow out of the present divorce
procedure might not be sensibl)
lessened. Tin right course is being
pursuedi however, and possibly in
the course of time the evil of migra
tory divorce may be overcome.
