NO NEEDLESS DELAY
IN THE DAVIS CASE
Statement Issued ly the State Land
Hoard Nothing to He Gained by
Hushing Matters Unduly.
Sai.k.m, May 21. In response to certain
criticisms which have been made of the
Statu LhihI Board relative to apparent
inaction in the matter of the Davis de
falcation, the following interview was
given out hy the members of tiie Lund
Board hint evening:
"The public Hliould not become im
patient in the matter of commencing
proceedings in the Davit) defalcation uu
ltHH the delay might result in propuhle
loss to the Htate. The delay of one week
or one month has not added anything to
such probability. Iloth the DaviB bonds
men and the memhurB of the former
State Land Hoard will be iih able to meet
their liabilities, whutever they may be,
three months from now an they are at
thin time. There has, however, been no
unnoccBHury delay. The final findings
of the in vtiHti'iitiut; committee have been
made but a Hhorl time and it wab thought
unnecessary to begin ttie proceedings
until the final report wau made, unless
there wuh danger of Homebody cutliti
uuuy. Mr. Duvisdisuppeured before the
first report of tiie committee wuh made
to the legislature, and in the resolution
of that body, directing tiie committee to
continue its work, it is asserted that
"there appears to bo u shortage or deficit
in Buid fimilH during the year ending
Deconibur 31, 1804, in thesum of 30,!Mi),
which appears to beiu no wise accounted
for." For the pnrpoBe of verifying this
first report the attorney-general was
instructed to further investigate the
matter and to prosecute the wrongdoers
to the fulleut extent of the law. Mr.
Davis disappeared immediately upon
tliti first public intimation that there was
shortage. The protection of the school
fund depended upon the bondsmen and
not upon Mr. Davis. The management
of tho entire question was tuken from
the hands of the present laud board and
placed under the direct charge of the attorney-general
by the legislature, which
fact is plainly Bet out in the resolution
quoted in tho Oiegoniau toduy. There
was nothing whatever, under the cir
cumstnuces for the laud board to do,
provided tho uttorney-goneral accepted
his duty and performed it, ami since Mr.
Davis disappeared at once, there bus
ueemed no necessity for undue haste in
the matter of proceedings against any
body (or financial restitution until the
report of the committee has been con

in this city, having met every organiza
tion included in the original schedule,
and Mrs. McKinloy's health has so far
improved that the president and his
party will begin tho return journey to
the national capital at 10 a. in. tomorrow.

included a reception at the Scott resi
dence to tho mem burs of the foreign
consular corps of tbia city, n reception
at the Palace Hotel by the Sons and
Daughters of the American Revolution
and the Loyal Legion in honor of the
president, and a review of the ecliool
children of Oakland by the president.

the opposition In the house, having
asked for Information respecting the an
nouncement that the jolut high com
mission was shortly to resume Us sittings,
Sir Wilfrid Laurier naid he hod reason
to believe the sittings will be reEumod.
It is desirable to brim; matters to. an
issue of some kind, he said. The Alaskan
boundary has not been eliminated, but
is in the very forefront of the negotia
tions. In justice to Canada and in
justice of Newfoundland, it is necessary
that the commission should resume. If
the sittings fail, Canada will have to
consider the question of revising its re
latinos with Newfoundland.
He also eaid it is important for all con'
corned that the Alaskan boundary be
definitely settled. If the commission
fails to reach a settlement and the
American and the Canadian contentiona
are ho far apart that the premier does
not see any assurance that a settlement
will be reached, and if a fair com promise
cannot be arrived at, then there must be
arbitration.

Dowie, the faith-healer, wa9 placed under
arrest today, pursuaut to the action of
the coroner's jury, which yesterday de
clared him criminally responsible for the
death of Mrs. Emmu Lucy Judd. H.
Worthington Judd, a diBciple of Dowie,
and husband to the victim, was also
placed under arrest. Both were taken
before Judge Tutley, who admitted them
to bail in $10,000 each. Henriku Bratsch
and Harry P. Speicher, mutemity nurses,
who were at Mrs. Judd's bedside when
she died, were arrested laBt night, and
later released under $5000 bonds. Mrs.
Judd died a week ago, after sixteen hours
of suffering. Her infant also died. She
was a member of Dowie's congregation,
and it is claimed she received no medical
uttention.

Piiilaubu'iiia, May 24. From the
eagerness with which the commissioners
of the Presbyterian general assembly re
newed consideration of the creed revision
question today, it appears doubtful if
the vote will be reached before tomorrow
noon. Even then, the vote will simply
be upon the question as to whether or
not the entire subject shall be dismissed.
Judge Humphrey opened the debate
this morning. He stated that he was in
favor of revision, but wue opposed to a
new creed.
Dr. Kennedy followed with a long
speech in which he upheld Dr. Baker's
motion to dismiss the subject. The
Westminister Confession of Faitii, lie
argued, was a scientific document and
never was mude for popular purposes or
understood by the muss of men.

London, May 24. An explosion oc
curred this morning at the Universal
colliery at Senghenydd, in the lihondda
valley. The rescuers are working with
the greatest difficulty owing to lack of
ulr. Five bodies have been recovered.
The wreckage of the pit is complete,
almost precluding hope that the im
prisoned men can have survived. Thero
are 78 miners missing.

MYSTERY
Stanley's Case Adjourned Until Chemists
Report Examination Set For
May 31st.
New YortK, May 23. Dr. Kirk Stanley,
the masseur arrested in connection with
the death of Father Phillips, has been
arraigned before Coroner Bauech and his
examination set for May 31st. The bail
was reduced to $5000. Stanley was
taken back to the Tombs in default of
bail.
At the hearing before the coroner,
Policeman Redmond told of the rinding
the priest's badly decomposed body and
of the subsequent arrest of Stanley. After
the policeman had testified Assistant
District Attorney Garvan aeked for an
adjournment of the case until a report
on the chemical analysis of the stomach
and intestines of the dead man could be
received.
Abraham Levy, counsel for Stanley,
protested against an adjournment, de
claring there is absolutely nothing against
Stanley.
"There is no criminal charce against
him," said the lawyer, "and it is a bard
ship to hold a man on a mere suspicion.
I don't care for any indiscretion be may
have been guilty of in not reporting the
death of the man to the police. That is
a matter with wnich the court has noth
ing to do. We all know that Dr. Witt
haus, the chemist, is not active in fur
nishing an analysis in such cases. I aEk
that you proceed with the examination
or discharge the defendant."
Coroner Bauech granted the adjourn
ment, and in doing so he said :
"I shall make an agreement that the
professor who makes the analysis shall
furnish a report within a seven days. A
longer time will not be tolerated by me.
I see nothing of a damaging character
againBt the defendant other than his
folly in failing to report the case. I do
not believe that Stanley was cognizant ot
the death of the priest."
When Corouer BuubcIi returned to his
office today he found it had been broken
into, the roller-top desk in which the
corouer kept his papers bad been pried
open, and there was evidence that the
pp.perB had been ransacked. The coroner
believes this was done by persons wish
ing to learn the real name of the woman
known as Mrs. Stanley.
