. Another legal farce is to be enact
ed in San Francisco, on a modified
line with the notorious Durrant case.
It is the matter of the convicted pris
oner, Cornelia Botkin, who is about
moving for a new trial. ' In the
event of a denial and the refusal of a
reversion by the supreme court of
California, this woman's counsel will
spring as a last resort, "the absence
of jurisdiction on part of California
tribunals to take judicial cognizance
of her crime." This is indeed a' pe
culiar co-mingling of tragedy and
burlesque, which will ever disgrace
the Golden state as long as its crim
inal code is not changed so that pet
tifogging lawyers may not toy with it.
The victim of Mrs. Botkin's hellish
act died in Delaware from poisoned
candy sent to her from California by
this woman. Governor Budd re
fused to recognize extradition papers
for the prisoner from Delaware, first,
on the ground that she was not a fu
gitive from justice, as designated in
the requisition, and second, because
she, in propria persona, committed
no crime in that state. As an evi
dence of the various constructions
that can be placed on the criminal
