A LARGE JURISDICTION.
The supreme court has taken a
new departure recently in the hear
ing of an argument on a demurrer
o ' '
taken on appeal from this district, in
the case of. tbe State against Ed
Martin. There are perhaps some
niceties of the law that may, might or
nnntd ber decided in the case : but
why take the time of the supreme
court, that has plenty of business an
guishing for its attention, to get an
opinion on these hair-splitting quil
lets of practice and procedure?
Martin is in default, being dead.
The process cf the court cannot be
served on him, nor its judgment exe
cuted. Between his body and the
court the clods that cover alike bis
viitnes and his vices, lie si!eht, but
all powerful. No bailiff can enter
his peaceful abode; no sheriff may
fchackle, no mandate move that in
animate clay. For him there is no
terror of imprisonment, no fear of
punishment; he is alike beyond the
power of earthly conns to convict or
acquit. The grave has settled that.
and Death, from whom there is no
appenl, has assumed a jurisdiction
which even the supreme court of this
great commonweath may not dispute,
Why then waste time in tr3'ing de
murrers or motions, or anything
concerning him, or his? Why de
vote daj-s to metaphysical discussion
that this or that shade of microscop
ical distinction of criminal nomen
clature mav be established for future
guidance in other abstruse discus
sions of legal will-o'-the wisps? Over
in the beyond Martin rests secure, at
least, from interference by our courts
bere, and if the common opinion con
cerning the legal fraternity is correct
tolerably safe from them in the here
after.
Time was when the grave ended
criminal litigation, but the supreme
court of this state has dived deep
and brought up a subject rmttter
from beyond it. It is time, high
time, that the number of our supreme
judges be increased. With their at
tention devoted exclusively to affairs
of tbe living, it will take it two
years to catch up with its work, but
now that it has come to judge the
dead, who is there shall say when the
end shall be?

Salem, one face turned toward the
future, ready to judge that which is
yet to be; one turned to the past to
judge that which has been, but is not
It is sincerely to be hoped, for the
standing of our supreme court, that
the rulings of the court below may
be sustained, else how with the man
date shall the supreme court retur
the prisoner into the jurisdiction of
the original court? Without juris
diction of the person, how may the
lower court proceed? -We do not
even hazard a guess, but respectfully
refer all who may care to calculate
the result, to one King Canute and
his tilt with the sea.
MORE ABOUT COAL.
The Dalles Commercial and Ath
letic Club has proven a grand success,
not only as a" source of social inter
course and enjoyment, bu as a grand
factor in the advancement of the
city'a interest?, and in aiding in the
development of its resources. It has
already done much. Before it are
grand opportunities to be grasped
and made subservient to c"ur pros
perity. . . . . , , .
There 13 one thing tbat above all
others demands its attention and
commends itself on account of the
vast benefits that may possibly flow
from it. " That is the development of
onr coal fields. All that Is needed to
test this matter is a diamond drill,
and all that is needed to procure this
drill and have it operated is $500.
It Is not expected the club will ad
vance this from its own resources,
but it, and we believe it alone, has
the ability to provide the money for
the purpose. Its members are our
bright .and prosperous business and
professional men. They meet within
tbe club-room on a common level of
self and public interest. They may
Jicuss the merits of the proposition,
and if disposed can. without much
effort, furnish the means.
At the risk of becoming tiresome,
and of being called a crank, we again
urge the necessity of some action be
ing taken. A good coal vein once
put in operation here, would mean in
a few short months the doubling of
our population, a rapid and general
increase in property values, an ex
tension of our business and trebling
of trade. We cannot afford to even
delay, let alone doubt the experi
ment. Work can be conducted as
well in winter as-in summer, and
with the work begun now, the early
lays of spring would see the matter
settled.
Gentlemen of the Commercial
Club, the matter rests with you, and
3'our fellow citizens anxiously await
your action.
