Issued oat of the Circuit Court of tbe State
of Oregon for Wasco County, upon a decree and
judgment made, rendered and entered by said
court on tbe 5th day of March, 1894, In favor of
the plaintiff, in a suit wherein Louis Klinger
was plaintiff and A. Mowery, Isaac Mowery,
Joshua Mowery, David Mowery. Maria Brady,
Catherine Williams, R. F. Gibons and L. Vander
pool were defendants, and to me directed and
delivered, commanding; me to levy Upon and sell
all the lands mentioned and described in said
writ, and hereinafter described, I did on the loth
slay of March, 1894, duly levy upon, and will sell
at publie auction to the highest bidder for cash in
liaad, on Monday,
the 16th day of April. 1894,
at 2 o'clock in the afternoon of said day, at the
front door of tbe County Court House in Dalles
City, in Waseo County, Oregon, all of the lands
and premises described In Bald writ and herein

Why Grateful Mormons Impose s Fine
for Killing the Bird.
Most interesting; of the birds that
we saw on our daily way to the pas
ture, says- a writer in the Atlantic,
were the gulls, great, beautiful, snowy ;
creatures, who looked strangely out of
place so far away from the seashore.
Stranger, too, than their change of
residence was their change of man
ners, from the wild, unapproachable
sea birds, soaring and diving and ap
parently spending their lives on wings.
From this high place in our thoughts,
from ' this realm of poetry and my
story, to come down almost to the tame
ness of the barnyard fowl is a marvel
ous transformation, and one is tempt
ed to believe the solemn announce
ment of the. Salt Lake prophet that the '
Lord sent them to his chosen people.
"The occasion of this alleged special
favor to the Latter Day Saints was the
advent about twenty years ago of
clouds of grasshoppers, before which
the crops of the western states and
territories were destroyed as by fire.'
It was then, in their hour of greatest
need, when the food upon which de
pended a whole people was threatened,
that these beautiful winged messengers
appeared. In large flocks they came,
from no one knows where, and settled
like so many sparrows all over
the land, devouring almost without
ceasing the hosts of the foe. The
crops were saved, and all Deseret re
joiced. Was it any wonder that a peo
ple trained to regard the head of their
church as the direct representative of
the highest should believe these to be
really birds of God, and should ac
cordingly cherish them? Well would
it be for themselves if other Christian
peoples were equally believing, and
protected and cherished other winged
messengers sent just as truly to pro
tect their crops. The shrewd man who
wielded the destinies of his people be
side the Salt lake secured the future
usefulness oi what they considered the
miraculous visitation by fixing a pen
alty of five dollars upon the head of
every gull in the territory. And now,
the birds having found congenial nest
ing places on solitary islands in the
lake, their descendants are so fearless
and so tame that they habitually fol-.
low the plow like a flock of chickens,
rising from almost under the feet of
the indifferent horses and' settling
down at once in the furrow behind,
seeking out grubs and larvae and mice
and moles that the plow has disturbed
in its passage. - The Mormon cultiva
tor has sense enough to appreciate
such service and no man or boy dreams
of lifting, a finger against his best
friend. ' Extraordinary indeed was this
sight to eyes accustomed to seeing
every bird that attempts to render
such like service shot and snared and
swept from the face of the earth. Our
hearts warmed toward the "Sons of
Zion," and our respect for their intel
ligence increased as we hurried down
to the field to see this latter-day won
der. - ' ' .

to the St. Louis Globe-Democrat, man.
"was away out in Montana several
years ago. It wasn't one of your fin
de siecle affairs of honor, nor was it a -glove
contest for points; it was simply
an attempt to decide who was able to
give and take - the most punishment.
Two burly fellows in our prospecting
party had a difference which they
wanted to settle by shooting each
other, and it was only by : disarming
them both that we saved their bullets.
The men were very surly after being
deprived of their six-6hooters and for
several hours did not speak. Then
they approached each other and con
versed with a calmness which some of
the party mistook for a burial of the
hatchet, and the wag of the crowd
handed over his plug and invited them
to .'chew the pipe of peace.' . A few
minutes afterward each man lounged
off into the adjoining timber, going in
opposite directions. . Feeling nervous,
I struck out after them. I lost the
track of the man I was following', and
despaired of finding him until I heard
a thud, like a man s skull being bat
tered. I followed np the sound and
was soon the spectator of a brutal duel
on the old Indian plan. The men had
drawn lots for first blow, and the loser
had stood his ground while his adver
sary tried to fell him with something
very like a club. As provided in the
code the men took turns in giving and
receiving blows, and when I got up
each had had two, if not three, chances
to brain the other. Each had his' face
covered with blood and was beginning
to be feeble. I stood for a moment
overcome with horror, and then draw
ing my revolver came forward and
compelled the combatants to ' quit.
Neither suffered permanently from his
punishment, and the exponents of one
of the most briHal dueling codes ever
heard of lived to. become fairly friend
ly with each other."

The little city of Mt. Vernon. New
York, owes its origin to communistic
discussions in a tailor's shop far
down Hudson street- The tailor and
some of his acquaintances finally
agreed . to put in one dollar ' a week
until the accumulations should reach a
sufficient sum to purchase a tract of
land in the suburbs of New York. The
little organization grew to contain
more than one thousand members, and
they put in one dollar a week for sev
enty-six weeks. Then, about 1851, they
made their purchase. Horace Greeley,
who was one of the subscribers to the
fund, jvished to range the private lots
about a central common, but to this
his fellows would not hear, and to this
day Mt Vernon has no considerable
public square. All traces of the orig
inal communistic scheme have disap
peared, though some of the original
subscribers may survive. -

that said City Council is about to pro
ceed to order and make the improvement
of Eighth street in said city, as herein
after stated, and that the cost of euch
improvement will be -levied upon the
property adjacent thereto, and said im
provement will be made- unless within
fourteen days from the final publication
ot this notice, the owners of two-thirds
of the property adjacent to said street
