Their capture is now only a question of a few hours. . They have been there since daylight, since which time the house haa been completely sur rounded, and escape is impossible. - At 14 a. m. a messenger was sent into the house with a note' from Sheriff Kay and another from a Catholic' priest, advising them to surrender to save life, as their capture was certain; The outlaws ha.ve ' detained the messenger as a hostage. The house is email, only two rooms, and easily commanded by the officers. About nosn there will be a general move on it if no surrender takes place before then. Undoubtedly ' there will be some . lives lost if the house is stormed. -. ' After waiting an hour for the return of Beason, the-messenger who was sent in with notes to Evans and Morrell asking for their surrender, it became evident that he was held as a hostage, and the posse .closed up, waiting for further de velopments. At 10 o'clock-Evans sent out a child with a note for Sheriff-Kay, asking him to come into the house, for consultation. It was then ascertained definitely from the child that one woman and some children were in the house with the bandits, besides the hostage they held. After an exchange of sev eral notes between Evans and Sheriff Kay, they finally agreed to come out if the officers would be instructed not to ahoot and the large crowd of people who had gathered to witness the affair were sent back. . ' THE, BANDITS SURRENDER. , At 10 :40 the door of Evans' cabin pened and Morell appeared and held up his hands, - followed immediately after by Evans without arms. They were immediately covered by 20 rifles and Sheriff Kay and Marshal Gard ad vanced and shook hands with Evans. A delivery wagon was pressed into ser vice, and they were driven rapidly to jail- " . Beason,' the man who was captured and held as a" hostage is an old friend of Evans.- He says that when he rapped at the door of the cabin Evans appeared with a gun in his hand, and after he had ascertained who wanted admittance, jerked him into the cabin and immedi ately slammed and locked the door.- He. then had Beason tell him the exact sit uation on the outside and asked his ad vice. Beason told him the whole coun try was aroused, that hundreds of men armed with rifles, shotguns and revol vers were concealed behind every fence, outbuilding and point of vantage, and it a impossible for them to escape. S 111 ' orriy J' . feet MR A were only waiting for the women and children to" be removed to make a de termined attack on the house. , Finally Evans concluded it would be impossible to escape, and making a virtue of neces sity, surrendered. ' '.' Evans looks very thin and pale, - as though be had passed through a severe spell of sickness. There is great re joicing here at the capture, as many persons had reason to fear his vengeance for giving information to '-officers, and there was a general, belief that some valuable lives would be lost before he could be captured. He is now safely lodged in the county jail, and it is safe to say will not be given any opportunity to-escape. ' . - EVANS BETRAYED BY A FRIEND. VisAiiiA, . Cal.", Feb. 19. Evans and Morell were expected here Saturday night, and United States Marshal Gard was telegraphed the fact at Los Angeles. They did not arrive, however, but came last night. W. V, Brighton , who lives in Evans', house, informed the officers of the bandits' arrival, and he was detain ed in jail until the full facts were earned. Marshal Gard arrived at 3 o'clock this morning, but Sheriff Kay and posse had the house surrounded all night to pre vent the escape of the bandits. Brighton and his wife have been living in Evans' house and caring for the four little children of Evans. Brighton has as suredly been acting, with the officers ; at least she gave the bandits away last night, but whether freely or under com pulsion is not positively known". . ,'. If Evan 8 is not Removed to the penitentiary trouble may occur tonight, as there are people here who favor taking possession of the prisoner and hanging him. They say oar community has suffered enough from the action of bandit Evans. The officers have heard the rumors and will take precautions J maybe-by sending the prisoners away by a special train. Fresno officers were notified this morn ing that he. was here, but none came to assist in the arrest. It turns out that Mr. Brighton and the children were not at home, only Evans and Morell being in the hohse. Bnt the crowd was too large for them to attempt to escape. . EVANS - PARTNER1 WAS NOT HORELX. The man captured with Evans this morning was not Morell. He says he is a man who worked in ' a dining-room with him. John March who met Evans several weeks ago at Churchill, in re porting the fact here, said that : people would not be surprised when . they learned who Evans' partner is. Sev eral citizens claim that the. man now under arrest with Evans is named En low. The yonng man was raised eight miles east of this city, in what was called the Swamp. Marshal Gard says Evans and Morell were not in the Eoscoe rob bery. He has known their whereabouts, he claims, for weeks. . East Seventy-ninth street from spinal trouble. - This was brought on by over exertion at the. world's fair, where a Puck building was erected. He was born in Vienna on February 1, 1838. News- comes of a double murder at a wedding in Allegheny county. Daniel Slaughter had a dispute with some per sons present. " Suddenly Slaughter sprang at John Bare and stabbed him to the heart. Bare fell dead and Slaughter dashed for the door. On his way he stabbed John Long, killing him in stantly. Slaughter was captured two miles away and safely .lodged in jail at Sparta.' The action of the Southern Pacific in boycotting the Atchison & Topeka tickets has aroused the latter's wrath, and as soon as Vice-President Robinson returns from' the Pacific coast, about next Thurs day, active preparations will begin. It . is not likely the fight will open until the Southern Pacific boycott goes into effect. Possibly before the trouble is over the . people may go from the Missouri river to the Pacific coast for $5. INJUNCTION SUIT : BEGUN. To Stop Proceedings on the Eeastern Oregon Asylum - Salem, Feb. 19. A suit in equity for an injunction was commenced in the Marion county 'circuit court today by the Btate of Oregon, upon the relation of A. C. Taylor, plaintiff, vs Sylvester Pennoyer, Phil Metschan and George W. McBride, in their capacity as aboard of commissioners. I - .
