it surely requires no lawyer to see
that tbe injunction suit lately initiated
before Judge Burnett of Albany, against
tbe trustees of the Oregon Soldiers' Home
Das not the shadow of a foundation to
rest on. The state constitution nowhere
provides that all or any of the public in
stitutions of the state shall be located at
the seat of government. The only refer
ence in the constitution to the location
of the state institutions is contained in
a provision in section 3 of article 14 to
the effect that it all the state institutions
should be located at tbe place chosen
for the seat of government then, in that
case, the place first chosen should re
main the seat of government for a
period of 20 years from its selection
Here is the section in question :

shall not be removed for the term of 20
years from the time of such establish
ment, nor in any manner than as pro
vided in the first section of this article:
Provided, that all the public institutions
of the state, hereafter provided for bv
the legislative assembly, shall be located
at the seat of government."
That is to say, if all the public insti
tutions shall be located at the capital
in that case the seat of government
shall remain in the place first chosen
for 20 years, but if any of the public in
stitutions should be located away from
the seat ot government the people could,
if they so willed, remove the seat of
'government to another place without
wartn-ng for the 20 years to expire. This
JBj by -every rule of grammar, the plain
meaning of the words, however legal sub
tlety may understand them. The word
"provided" implies a condition, and
qualifies the provisions tbat percede it

ment, twenty years must transpire be-
.ore the capitol can be removed to
another place. As a matter of fact all
the state institutions have not been lo
cated at Salem, Cor'allis having the
agricultural college and Eugene the
state university. Is it possible that
these institutions have been located
there in defiance of the constitution and
that the Salemites or whoever they may
be who are at the bottom of the pend
ing injunction suit have only now made
the discovery? Is it conceivable that
his excellency, Gov. Pennoyer, whose
powers for detecting things unconstitu
tional are well known, should have al
lowed the bills for the soldiers' home
and branch asylum to have become
laws without giving the alarm before of
unconstitutionality? We think not.

FINANCE NOTES.
Cincinnati claims 8,664 different in
dustrial concerns, with an annual in
crease of from 500 to 600.
Sheep rearing is said to be declining
greatly in New South Wales. The
number of sheep in tbe colony on Jan
uary 1 this year was 58,619,616, a de
crease of 3,211,800 compared with the
year previous.
Mr. Leonard Courtney, who is one of
the convinced bi metallists, writes to the
Nineteenth Century on this interminable
subject. He has a suggestion of his own
which he thinks both good and practi
cai : -Assuming mat tne existing mar
ket value of silver showed a ratio be
tween it and gold of something between
23 and 24 to one, he would provide that
the mitn receive silver bullion and
grant certificates therefor which should
be legal tender at the ratio of 25 to one.
Five years ago I joined with my friends
in deprecating any attempt to establish
an international agreement for the free
coinage of both gold' and silver as stand
ard money. I have advanced, with
further reflection, to the belief that such
an agreement is to be desired, and tbat
it could be accomplished with the mini
mum of change and with great advan
tage to the empire and the world on the
conditions I have suggested."
A writer in the Atlantic gives this as
the origin of the slang word "socdolla
ger," which was current some time ago.
"Socdollager" was the unedueated
man s transposition of "doxologer
which was the familiar New England
renaenng ot "aoxology." This was the
Puritan term for the verse of ascription
used at the conclusion of every hymn,
like the "Gloria," at the end of a chant
ed psalm. On doctrinal grounds it was
proper for the whole congregation to
join in the singing, so that it became a
triumphant winding up of the whole
act of worship. Thus it happened that
"socdollager" became the term for any
thing which left nothings else to follow;
a decisive overwhelming finish, to which
no reply was possible.
