Interest tn these hearings has been
stimulated by two recent events. One
is the commission's announcement - of
plans for consolidation- hearings,-beginning

Considerable preliminary woric' has
been done by Commissioner HaAwho
some time ago was given charge of
the shaping of the plans for consoli
dation under the Each-Cummins act.
Professor Ripley of Harvard was en
gaged to prepare a tentative -set of
groupings, and did so. Later the com
mission promulgated a tentative plan
under its own authority, which fal
lowed iri general the Ripley plan, but
made many important changes. The
commission is not bound by eithex plan
as to its .final action, the alternative
plans being regarded as - a means of
reachinjg results by having "something
to' shoot at."
Systeim No. 14 of the commission's
tentative plan, designated as theBur
lingtoni-Northern Pacific- group.1; and
, No. 15, the "Milwaukee-Great Northern
group, are the ones set down for hear
ing on November 17, and among the
questions to be considered, is whether
the Spokane, Portland and Seattle will
fall into one group or the other. It is
jointly owned -by the Northern Pacific
and Great Northern, -which apparently
will belong to different systems. The
main affirmative case, particularly the
documentary evidence is expected to
be presented stt Washington.- to be
followed by separate hearings in the
West, where state commissions, com
munities and the public generally win
be given opportunity to .'present thej
local viewpoint, knd to croBS-exaftlne
witnesses on testimony of Jhe carriers
which, has been heard at Washington.
TO PERMIT AIX ETIDEIfCE
The commission has Announced that
it will permit the Spokane, Portland
& Seattle to present all of its evidence
at the, Western' he-ring if that is de
sired, by its Officials, and smaller
roads In the same territory will be al
lowed the same privilege....
In the Ripley plan it was proposed
. to- unite the Central Pacific and Union
Pacific, while the commission's - tenta-.
live plan groups the Central with " the
Southern Pacific, a difference that is
i noted with interest since the supreme
court has found, that the Central and
Southern were unlawfully ' combined, j
followed by , prompt , action of the ,
Southern in . requesting1 authority from
the commission to .lease the Central
until 19S5. unless it shall be found in
"tHe -meantime that this interferes with
-the final plans of consolidation.,
l-The provisions of the transports
tion act."., saysf the . Southern Pacific
petition, "especially section " 407, 1 con
stitute a radical cbangfe in. the legis
lative policy Of congress in respect
to the application of the Sherman law
to the railroads of the Country. They
evidence a recognition on the part of
congress of the fact "that-the compre
hensive regulation and control ' of in
tej-staie carriers now vested in this
commission renders unnecessary for
the protection of the public the Strict
and inflexible application to such car
riers of the prohibitions of the Sher
"mn law and similar laws : that On the
contrary the public interest may be
, netter served oy relieving sucn car
riers, when acting under the authority
and supervision of the commission,
from the. rigid requirements of such
rigid legislation." J
The commission is reminded that
congress by law has made- it the sole
jvldge of ihe question of public interest
and! that the case before the supreme
court was closed before the transpor
tation act - of 1920 came along and
altered the .policy.
