Friendly Suit Is
Started for Testing
Transportation Act
A friendly suit to determine tha mean
ing of certain points In the national
transportation act haa boon started in
tha federal court by Robert E. Strahorn
against the Oregon. California It East
ern railroad. Strahorn charges J47J 000
worth of capital stock la due him for
turning over franchises and rights to
ff road property ho held prior to 4ay
The complaint sets forth that Stra
horn sold his rights to the property for
$00,000 worth of capital stock. Of thla
sum $128,000 was paid. James Q. Wll
son. secretary of the railroad company,
ia aaid to have refused to turn over the
remainder of the capital stock until he
la sure of the Interpretation of the trans
portation act.
The suit Is declared to be friendly
having been filed for the sole purpoee
of obtaining a clear Interpretation of
the act from a federal Judge. Fear that
the contract between the parties may
not be entirely legal led to the suit.
European reconstruction. Harvey's atti
tude, it was believed here, would produce
first Intimation of American Affyis,) sen
timent toward the plan.

sirable to transplant their production

nation of the suggestion if such a move
actually ia threatened.

Man Jailed: Use of
Influence No Avail
Salem. Jan. 3. After the machinery of
the city government bad refused to func
tion in releasing Grocr Powers from
behind prison bars, where he is serving
a 20-day term on a liquor charge. Gov
ernor Olcott was appealed to Monday
night by friends of the imprisoned man.
but in vain. The governor refused to
act unless the appeal were accompanied
lease from the judge who sentenced him.
Powers, who is prominent locally, was
arrested mursaay night in a raid on
his residence, where a quantity of liquor
was discovered, and was assessed a fine
of 100 and a sentence of 20 days in
the city JaiL .
