JUDGE GRIFFIN
! URGES NEW TRIAL
T
FOR
OM MONEY
:Deciares Witnessed in Hearing
U Following Preparedness Day
Explosion Are Discredited.
Z San Francisco Nov, 20. "There
only one lndicitment In my court
against Thomas J. Mooney, and that
ia for murder in connection with
'the Preparedness ; day bomb' explor
:ton, which occurred July 22, 1916.
I most certainly think he ehould be
rirlven a new trial," said Superior
Juflge Frank A. Griffin in an tnter--vlew
given to Universal Service to
day. . :
"I have thought all alone that Mooney
-Should be given a new trial, and my
jttand has not been changed since I
Twrote my letter to Governor William
. Stephens, November 19. 1919. in
.which I explained my stand fully,
t "By this letter I urged the governor
-to act on behalf of Mooney, so that a
.liew trial could be held, but the only
action he can take would be to par
don him.
- "It was my belief at the time, and
4t is still 'my opluion, that there were
only four witnesses connected with the
-Mooney . Preparedness day murders, in
"which 10 persons were killed and DO
-others were mors or less seriously in
jured. One i of these witnesses was a
-periiirer and two others have been dis
credited since their testimony was
' 1ven" '; ' '
Judge Orif fin characterised John Mc
Donald, one of the witnesses, as a per
jurer, and Mrs. Nellie Edeau and her
daughter Sadie as discredited wit
nesses. . -"
"To my mind. Frank C. Oxman, the
Oregon cattleman, was by far the most
important witness in the casef but recent-
developments, especially the state
jnnts made by Policeman Draper
-Hand cast doubts on the veracity of
.his testimony," continued the Judge.
- '"No action has as yet been taken by
Governor Stephens- in the matter, as
"far as I am aware. What District At
torney "Brady's intentions are in the
-Mooney . case I do not know. I have
Already made myself clear on the sub
ject, and the next step must come from
Ihe governors oince.

V Spat. With Hubby
r Dr Esther Fohl-Lovejoy has returned

iarium on the North Umpqua river and
3ias filed an injunction suit against its
promoter, her husband, George A. Love
Soy and Dr. V. U Ruter. Another .in
junction suit is being prepared, with five
plaintiffs, consisting of the state board
f health, the city of Roseburg, which
"obtains its water supply from theNorth
tJmpqua river, Douglas county, Douglas
.County Light & Power company and Dr.
Lovejoy. - ... "
Principal objection to the sanitarium
lies in the danger it would Impart to the
-health of Roseburg citizens through the
contamination of its water supply. De
pendents in the case maintain that proper
sewerage system will insure sanitation
,-a.nd will prevent pollution" of -the water
Tsupply, and insist that Dr. Love Joy ob
jection is largely a. selfish one, based
Mpon the depreciation in value It will
"give, her adjoining property.
Ruiter is the" inventor of an electric--herapy
method of tuberculosis . treat
"jnent, of . which orthodox physicians are
Skeptical, it is said, and Dr. Lovejoy. as
president of the International Association
Women Physicians, has said she does

fession imperilled through any connec
Viton of her name with an institution of
