HASTE URGED IN

pany Doesn't Care Whether It
or the Government Builds Dam.
Klamath Falls, Nov. 20. As a re
sult of a two-day hearing over the
matter of buHding a darn at the out-;
1ft of upper Klamath lake, tho air
has been clarified and a better un
derstanding and feeling has been
brought about.
The California-Oregon Power com
pany Jieb announced It does not care
whether it builds the dam or whether
the government builds it. .AH it cares

possible, (to that the water may be
made available for power purposes.
J. 11. Carnahan, commander of the
Klamath Falls post of th American
. legion, who has been thp most inter
ested In stirring up this Investigation,
examined Paul It. McKee, general man
ager of the California-Oregon Power
company, on the stand Friday and elicit
ed the statement from him referred to
above." Mr. Carnahan has taken the
'aland, that there was. a "nigger in the
woodpile" in the contract between the
power company . and the -. interior de-
partment, and that water for the irrl

not be available in years to corns when

McKee denied this most emphatically
and stated that there would be an am
ple supply of water over and above
that which was needed for their power
developments, and that they would not
attempt to control the overflow.
All the depositions taken at this hear
ing and all of the testimony will be
laid before Secretary Payne on De

damn dam as long as the damn dam
. was . built.'

of magnificent Douglas fir trees on the
Hon watershed Is perhaps the finest and
largest of any In the entire country.
The Olympic Peninsula Development
association, organized last summer, has
a definite program for putting through
the Olympics highway around the west
side of the Olympic peninsula, said
Fromme, to connect up QuinaUlt lake
with Forks. The 15 miles of "this road
between the- mouths of the Hon and
Queets . rivers will border the coast
rather than go through the Christmas
creek and Snohomish pass. This will
make a more scenic route.

preme court an original proceeding
in mandamus to compel the! public

At tVio time amplication, which effects
the Central Oregon irrigation district
was filed the petition sets out. it was
generally conceded that an irrigation
company engaged in supplying water to
an. irrigation district was a public utility
coming under the jurisdiction of the
public service commission. Acting on
this assumption the members of the com
mission proceeded to Redmond, where-a
hearing into the merits of the rate ap
plication waa held. At that hearing the
jurisdiction of the commission was at
tacked and in an opinion written by At
torney General Brown it was held that
an Irrigation district waa not a public
utility and not subject to the jurisdic
tion of the state regulartry body so far
as rate making was concerned.
This opinion is contested by the com
pany which seeks to have this point
passed upon by the supreme court. The
proceeding was filed by Denton G. Bur
dick of Redmond, and Jay Upton of
Prineville, attorneys for the company.
