A short time ago Dr. Howard repre sented to Judge Taswell tliat Fulton refused to defend her In certain litiga tion with wjilch he was familiar because he did no0 hnve funds available for his fees. Goldstein to Ask Removal of Agents Who Shot Hedderly Charges that federal revenue agents who participated In the arrests that led to the death of Bert Hedderly, alleged bootlegger, are unfit to serve as orf leers of the law snd to carry arms, will be filed with the department of internal revenue at Washington. D. C, according to the statement of Bsrnett Goldstein, former assistant United States attorney. who Is representing Mrs. Hedderly. The same charges will be filed with Mayor Baker against Patrolmen E. M. Jackson and W. D. Morris. The federal agents Involved are Wood, Biggins and Smith. Goldstein will defend C. J. Lewis, al leged to be Hedderly's accomplice, in federal court Wednesday. He declares he will subpena the patrolmen and rev enue agenta and prove by their state ments that they had no authority to ar rest Hedderly and Lewis, much less to tire the shot that caused the former's death. It Is understood that the Multnomah county grand Jury Thursday will begin an investigation as to who was liable for the death of Hedderly and whether there was criminal carelessness in the discharge of firearms. The grand Jury Investigation will be under the direction of Thomas, Magulre, deputy district at torney. Relatives of Hedderly nave re quested the Investigation, .
