retary of state today for approval as

Salem, Or., April 21. Holding; that
a- circuit court has no authority to
compel a husband during the pendency
of a. suit for divorce and before the
decree la entered therein, to pay the
wife alimony for rier support or for
medical or surgical attendance, the
supreme court today reversed that
portion of the order of the circuit
court for Clackamas county which al
lowed Mrs. Minnie N. Taylor 1866 for
support and surgical attention during
the time the suit brought by Charles
P. Taylor, a millionaire, for an annull
ment of his marriage with her was
pending. The rest of the order, which
allowed $2500 for attorney fees, was
sustained.
The Taylors were married In Port
land la 1905, lived together four years
and in 1910 he began a suit for divorce
on the ground of fraud on the part of
hi wife Jn Inducing him to marry her.
Since that time the two have been
fighting -la the courts.

court held that under the Oregon stat
utes alimony cannot be required until
the final decree In a divorce suit Is
made.- ,

against Harvey E. Cross, an Oregon
City attorney, came up for trial before

life Imprisonment for the killing of
Herman Poch, In Crook county, was
given a new trial teday by -the su
preme court. Trie case was reversed
and remanded to the -lower court.
Cause of the reversal was an error
on the part of the tower court in al
lowing declarations and admissions
made by Mrs. Fannie Poch, who was
jointly indicted with' McDaniel for the
crime, after the crime had been used
as evidence against McDaniel. These
