court today held that -the law impos
ing on foreign corporations an annual
license fee- baaed upon .the amount of
capital stock is unconstitutional on the
ground that It imposes the tax upon the
whole capital stock' of A foreign cor
poration, Irrespective! of whether it
ia employed in this state. The other
provisions of the corporation law, how
ever, are held to be valid.) .
Having knowledge that the supreme
court would likely hold this provision
unconstitutional, the last legislature, An
the last day of - the session, rushed
through a law imposing a riat raw li
cense of $100 a year for all corpora
tlonsrM'hls will save to the state the
Income of over $60,000 a year that Is
derived from foreign corporations. .
The question came before the court
on a rehearing of the case or Leo

this afternoon that Sam Francisco's sub
scription for Ohio and Indiana flood
sufferers now totals $75,000 with every

and forty-nine dollars was received at
the, Red Cross offices "here today, mak
ing their fund $62,753. ' The Knight of
Columbus, alone raised $10,000 for the
flood sufferers.
