get any branch railroad's traffic, when
built, over either the Harriman or Hill
lines, into the city of Portland from
points, in western Oregon without Harri
man's personal consent. And he invari
ably refused. , I tried it, and after
building 141 miles of rallwav from near
Eugene and Airlle Into Dundee and part
ly graded from the latter Junction Into
Portland, Henry Vlllard. in 1882, (the
O. R. & N. company) stopped me there,
and after I had built nine miles
graded, from Hlllsboro in the di
rection of Tillamook and to Astoria, Mr.
Harriman, when he found I had in 1904
a bond contract from the great Atlantic
Securities company (Rockefeller) ' to
supply moneys to, and guaranteed in
writing themselves to build Into Hllls
boro, provided we got,, from the latter
city, a traffic agrooment (not trackage)
into Portland over the Southern Pacific
lines, not only absolutely refused to give
the latter but also refused when I asked
lilni to build from Tillamook himself
over my grade at its valuation by arbi
tration. , ;. ' . "" '

able any railroad then coming into Ore'
gon to reach the city of Portland. -
It Is universal custom in Europe to
exchange trafflo connections with other
ltnes and Into London, Glasgow, Liver
pool and therein, (not the merger plan),
but the law of Great Britain gives com
pulsory traffic connections thereto, and
I presume Julius Kruttschnitt's recent
six months visit there and tn contl
nental Europe has caused him since to
propose as today's newspapers say he
has done, to the supreme court of the
United States, compulsory granting of
ths Union Paclflo-rsllway's freight te
enter San Francisco by way of Eenlcla
by a traffic agreement with the South
ern Pacific company only and not by

or lease thereof from Racranlento to

In conclusion I would suggest that
the state ot California pass as Oregon
did In 1905 a general compulsory traf
flo connection law applying to all rail
roads in California.', Without that law
ths country produce. In Oregon could not
reach Portland over lines hereafter built
by other local companies in th interior.
This is verified by an opinion given to
the Oregon railroad commission from
the attorney general of Oregon, a copy
of which I have In my possession, and
which says that whenever any branch
railway in the Interior of Oregon is built
to a connection with any main line going
Into Portland, the latter Is bound "no
lens volens" under the act of 190S to
carry its freight and loaded cars, with
out breaking bulk, Into the city of Port
land, not at rates to be charged by the
railway carrying the same into Port
land, but by rates fixed by th governor
of Oregon and state treasurer or a ma
jority of these officers every two yeara
Could anything be clearer? Or could
anything serve better to build up Port
land as the metropolis of Oregon which
was the object I had in view in getting
that law passed despite Mr. Harrlman'i
opposition and that of th speaker of
