NEEDS ARE DISCUSSED
The first "get together? meeting of
the Portsmouth Commercial club, since
. Its organization Uttt June, took place
last night when a banquet was held In
-the Odd Fellows hall at University Park.
Nearly J5 prominent citizens of the
"Portsmouth district were present and
- listened to tha various speakers with
rriuch interest. Among the subjects
idtscussed were the bond Issue which is
to be voted on November 2, and pro
nosed Improvements for Pennlnsular
park.
Among the speakers at the banquet
were L. H. Weir, Professor A, E, Cham
berlaln, of St. Paul, development com
missioner of the Great Northern rail
road, J. J. 8ayer, Rev, Edwin V. O'Hara,
K.'W. Graham and E. T. Mlsche, park

Pending In the United State District
Court of Idaho is a perjury case, the
result of which Is eagerly awaited by
those who are Interested in having the
agricultural land within the. national
forests taken up by bona fide settlers.
William, J. Nelson, July 84, till, maae
application to enter tinder the- provis
ion!, of the Forest Homestead Act of
June, 1906, a certain tract of land within
the boundaries of the Coeur d'Alene
National -Forest-ta-Idaho-shortly- after
tha plat of survey had been filed. Nel
son made affidavit that he settled on
the land prior to November 6, 1906. when
the land was withdrawn for national
forest purposes, and had since settle
ment, continued to reside upon, improve
and cultivate the land. The government
charged that the statements made in" the
affidavit were false and an Indictment
for perjury was returned.
The Indictment waa demurred by Nel
son's attorney on the ground that It did
not state facts sufficient to constitute
a publio offense,-contending that the
affidavit wa, not, required by law and
that even with the statements false,
tney related to Immaterial matters and
could not serveas the basis of a per
jury charge. v
In the demurrer proceedings, tne court
held that It was material for public land
officers to know which of two applicants
was In actual occupancy of the land in
order to decide which application to
accept and to that end might require
an affidavit ana tht tne applicants
right to the land might depend entirely
on the affidavit. The courts concius
Ion was that the inquiry which Nolson's
affidavit answered was a material one

In a case in which an oath is required
by law, The court held that it was not
essential to the offense of perjury that
the oath taken should be expressly pre
scribed by statute, as proper officials
are employed to enforce and carry Into
execution by "appropriate legislation
provisions of law relating to the dispo
sltlon of nubtlo lands. It was shown
that these officials have prescribed the
taking of an affidavit to be made by
homestead land applicants. The court
took thee stand that because the false
affidavit was made, an indictment tor
perjury would not be dismissed.

days ago to the' daughter of a prominent
Mexican family. For some unknown
