Tba exact number of days' delay was
237 and for each day tha United En
gineerlng ft Construction company
would be liable to a penalty of flOO, or
$23,700 altogether, if tha delay waa not
unavoidable. However, Waddell A Har
rlngton, the consulting engineers, em'
ployed by the city, reported that the
United Engineering company should
be penalised to the amount of $3000,
and that the company should be en
titled to recover from the city $6266 by
reason of damage sustained by tha com'
pany owing to the failure of Robert
Wakefield, the aubstructure contrac
tor to have his part of tha work ready
for the superstructure builders. The
engineers recommended that-Wakefield
be penalized only $2800, Instead of $11
8C0, what the penaltlea for 237 days'
delay would aggregate.
Redactions Allowed.
These reductions In the penaltlea
were allowed by the engineers for the
reason given by them, that tha contrac-

Tha letter of the mayor was referred
to the bridge committee of tha execu
tive board. The committee will ask
tha elty attorney to render an opinion
stating whether or not ha believes the
recommendations of tho consulting en
gineers are mandatory on the city.
Concerning what may be tha future at
titude of the city the mayor says. In
conclusion:
"You will observe from tha provis
ions of tha contract that I have quoted,
that the? Is a legal queatlon Involved
aa to what extant tha Judgment of the
consulting engineers shall determine
tba amount of the penalties thst msy
be enforced against tba contractors.

"I suggest that you take up this
question with tha city attorney, and
get hta opinion as to tha power of the
consulting engineers -to adjudge- tha
amount of penaltlea that may be en
forced, and how far thelrjudgment will
bind the city, and that whan thia has
been .determined, you ascertain the
amount that still remalna due tha two
contractors, aa well as tha consulting
engineers. I think I may aafely atata
that tha elty of Portland does not In
tend to repudiate any part of Its just
obligations.
"Wnen tha amount has been ascer
tained, tha council should be requested
to make a sufficient appropriation to
meet whatever, deficit there may be In
the Hawthorn avenue bridge fund to I
pay the amounte found to b Juatly due
from tha city of Portland."
