cability of the referendum has been
definitely decided," continued Mr. Lom
bard. "It is an outrage against the tax
payers of this city that the railway
Is committing when It thus contemp
uously sets aside the referendum."
The committee of three representing
the East Side' Business - Men's -club,
through which the referendum was in
voked, held a meeting In the office of
City Attorney Kavanaugh yesterday aft
ernoon. They asked that official to ar
rest the O. R. & N. on a charge of ob
structing the streets. .
Mr. Kavanaugh advised the commit
tee that a better plan of procedure, in
his opinion, would be- to file an Injunc
tion asking the circuit court to -estop
further construction work on the bridge
abutment being put in by the railway
company, until the question of whether
or not the referendum applies la Co-

lie further stated that ha did not be
lieve the referendum would apply to a
street vacation ordinance. Notwith
standing the city attorney's unreiponse
ful attitude, the comrtiittee was firm In
Its Insistence that he arrest the rail
way officials. Mr. Kavanaugh then told
the committee that he would prepare the
complaint, . but would confer with the
mayor before serving It.
After a conference with Mayor Simon
and Deputy City Attorney Grant later
In' the day Mr. Kavanaugh decided not
to serve the arrest warrant at all. State
Senator Dan Kellaher, of the committee,
Is now arranging to have a- writ of man
