Th flrat. that was' heard of th Blu
Mountain reserve was when the McBrlde
and Simon protests were aent to tha
land office In 1900. It was September,
1901, before Hermann had ' seen these.

Next; in the government case, came
tha. alleged 'meeting of Hermann and
Maya In the office of Meldrum.' Senator
Oearln contended that the government
must connect him at this time or fall
to convict They had tried to do thla,
and only In a faint manner . had suc

Heney had been frank In saying that
unleas : th Jury bolleved the story of
Meldrum, that, they ahould acquit the
defendant. The apeaker then dissected
the' Meldrum testimony, showed its
weakness, and pointed to th manner In
which the defense had . contradicted it
while at th earn 'time he pointed out
, th fact that Meldrum had 'told two
i different etorles, on at the Washington
trial and on at the present trial.

Even 'if the story ware to be true, the I
aenator - contended. It did not connect
Hermann with the conspiracy. . It was
not contended that there was an express
agreement between Hermann and Maya,
but that Hermann should have known
of th corrupt Intentions of Mays and

Every one conceded that the reserve
was needed, even Mr. Henay. Xo one
had aald that there was fraud In Its
creation, and there was no evidence to
show any intimation of fraud against
the reserve. The prosecution must prove
that Hermann knew of the fraud, and
they had not done It and could not do It
The Mitchell- petition had shown no
intimation of fraud. The telegram of
Hermann to Maya telUng of the with
drawal of the,, lands In the reserve , did
not show fraud or conspiracy.

The speaker then turned to the Her
mann testimony and contended that no
man could have been three days under
the fire of cross-examination, as Her
mann ' had been, and have told the glib

The testimony, Oearln said, showed
that George C. Brownell had been play
ing politics, and It was on ttls rotten
stuff that the government had bullded

with an eloquent appeal to the Jury not
to rob th defendant of the reputation
and good name which he had been
guarding during : his long life, but fto
return him to his friends and fanlly
vindicated.

broken up. . On March 1, th reservation
will be thrown open for filing. , A rum
bar of Tuma men familiar with the re
ervatlon lands had figured on reaping
a harvest by guiding prospective land
seekers over the reservation. A number
had eomblned, forming a virtual monop
oly of guides, and had put their prices
up to a highly profitable altitude.
Miss Kgan, th Indian agent, learned
of th mlntatur trust and started out
to "bust It." Asslated by Project En
glneer Francis Bellow, she organised an
Information bureau and arranged to sup
ply all essential Information to land-
seekers free of charge. Th office was
opened at a point near th Southern Pa-
