cent of the total deposits in all op-the
said banks, subject to the provisions of

sessment shall be levied upon the cap
ital stock of the banks subject to this
act, according; to the amount of their
deposits as reported in the office of the
board of bank commissioners. And
said special assessment shall become
immediately due and payable."-

It Is further provided that any bank
which may become insolvent, or its
rights to conduct a banking business
shall have been declared to be forfeited
by reason of improper- banking opera
tions, the bank examiner or his assist
ant shall tako 'charge of the institution
and close up Its tuslness, paying any
deficit out of the stat guaranty fund.
In such a ease all depositors shall be
paid at once, or as soon - as their ac
counts can be checked up, the money of
the guaranty fund being used after the
cash on hand in the vaults of the in
stitution has been exhausted. The as
sets of the bank are then to be con
verted in the best possible manner by

ment of one of District Attorney Lang
don's assistants today.
Brown was indicted with other offi
cials of the institution - and in return
for a complete statement incriminating
his associates was granted immunity
from punishment on all charges pending
against him except one, on which he
was oonvlcted and for which he is now
serving 18 months in San Oiiontin
prison.

four months. By virtue of the man

therewith, the result of the election on
prohibition, which was held last June,
was set aside on the ground that the
notices calling th election were not
properly posted.
