the circuit court this morning; asking
that subpoenas be Issued for the appear
ance of the Eugene men to testify when
the case of Finch is called for trial on
Friday morning;.
The affidavit of the attorney says he
Is informed that Walls and Kissinger
will say that on the afternoon of No
vember 28 they were standing: on the
RiaewaiK at a point opposite tne win
dows of Fisher's office, and that on
chancing to look up they aaw a struggle
in progress.
Then, as the affidavit runs, they saw
Finch standing; with his back to the
window and his hands extended in the
air. A moment later they heard shot.
They could recognize Finch, because
they had known him for many years,
and they knew his features as he moved
about quickly In a scuffle. -
The call for these subnoenas shows
that the attorneys for Finch are work-
ins; on tne sen oerense theory, despite
the testimony of MWs Verna Burkhart,
nsneri stenograpner, who witnessed
the shooting from the office door and
