Hereafter Be Rigidly ' In
vestigated Before Honest
' Settlers Are Troubled
Sckejming Practice to End.
Men who file contests on homestead
claim' in the Siletx country from" this
time on will have to be sure that their
grounds for contest are .Valid and that
they have their evidence In hand be
fore they file, or -they will find them
selves In hot water with the land de
partment. - ' -
Orders have been sent to Oregon land
offices and to C. R. Glavls, chief of the
field division work of the land depart
ment, from the interior department, to
the effect that no- contests ehall be
allowed until Mr. Glavls haa made a
personal Investigation which will sat
isfy htm that the contest is made In
good faith and upon sufficient grounds.
This ruling is expected to put an end
to the contest abuaea which have ex
isted In relation to Silets homestead
claims for some time past.
Time Timber Coveted.
In the Silets district is some of the
finest Umber In the state, and thla
has been much sought after by the tim
ber barons and by dthers who desire
to secure title to the land for specula
tive purposes. Out of this condition
has grown the contest abuse. Men who
have srone Into the Silets in good faith
and have filed upon homestead claims.
there have had these claims contented
right and left by men who have gone
in either for personal speculation or as
the agents of timbermen who desire the
land,:. So common did the abuse be
come that there were a number of law
yers in Portland who did nothing else,
practically, but represent these contes
tants. In many of these cases the con
tests were fUeji for purposes of black
mall, it being represented to the home
steader that the contest would be
dropped if he would pay sdme certain
sum ' to secure such action. If the
homesteader did not meet these de
mands, he would be put to the expense
of gathering hla witnesses together,
bringing them to Portland for the hear
ing and hiring an attorney to repre
sent him only to find that after he had
done all these things the contestants
failed to appear at the hearing.
Appeal to Washington.
So notorious did the practice become
that the settlers appealed to the Ore
gon Relegation In eengrreas for" assist
ance. The matter was taken up by
Senator Bourne with the department of
the interior and the general land office,
and after hia presentation of the case
the order recently sent to the officers
here was promulgated.
This order will nut out of business
the lawyers who have been making the
contest cases their principal means of
livelihood, and will at the same time
protect both the honest settlers and the
honest contestants who may ' have
grounds for contesting an entry made
illegally or for fraudulent purposes.
BACK FROM EAST
C. P. Wright and wife Beturn Prom a
Mine Week's Trip.
C. F. Wright and wife returned last
Friday from an extended tour of the
southern and Atlantic states. They
spent some time at the national capital
and visited relatives in Jamestown, New
York and in Montana on the road home.
Mr. Wright reports that the prettiest
part of their trip was their tour of
the New England states most of which
was made In an automobile. They mo
tored over the Berkshire hills of Ver
mont and through Connecticut and
Massachusetts. The weather during the
trip was delightful and the autumn
foliage was at Its hfst. Several days
were spent in the vicinity of Niagara
Falls. In speaking of Detroit Mr. and
Mrs. Wright both agreed that If they
had to move elsewhere, Detroit would
be. first cholc on account of Its well
paved streets and general air of pros
perity and thrift. "The most scenic
lines we traveled over," said Mr. Wright,
"were the Denver and Rio Grande, New
York Central on the Hudson, and the
Northern Pacific in the Rockies."

FRUIT GROWERS TO
MEET TUESDAY
This week Is horticultural week tn
Portland and S00 or more fruitgrowers
from the states of Utah, Idaho, Wash
ington and Oregon and the province of
British Columbia will be in the city.
The state horticultural society will
open Its annual sessions on Tuesday at
10 a. m. In Woodmen hall. On Wednes
day and Thursday the Northwest Fruit
growers' association will hold -its an
nual meeting in the name place.
'During the whole time there will be
an excellent exhibit of fruit open . to
the public both day and evening.
The program proyided for the several
.seantons Is one of the bent ever pre
sented before the fruitgrowers and the
convention promises to be the most
successful event of the kind ever held
In the Pacific northwest.

Bid Will Make Money for
City If Claim to Reduction
for Outages Is Dropped.

troversy between the city executive
board and the Portland Railway, Light
& Power company over the city light
ing next year by the statement of Presi
dent Josselyn that if the company's bid
is accepted it will mean a saving to
the city of 127.000 for the five years
the contract Is to run provided the city
will drop Its contention that the btll
for 1908 be reduced for "outages."?
This statement of the president of
the electric company, Issued late yester
day afternoon, directly contradicts the
tenor of the report of - Thomas G.
Greene of the lighting committee of the
executive board, as published in yester
day's Journal. Mr. Greene told the ex
ecutive board that if the city would
not abandon Its claim to $29,000, .the
deduction for the "outages" .and to
which he believes the city is entitled,
it must, according to the electric com
pany's demands, pay an aggregate of
50,000 in the next five years for its
lights.
A significant feature of President
Josselyn's statement Is his remark that:
"No official of this company has been
authorized to state that we will not
turn off city lights December 81 If a
new contract is not entered Into with
this company." Mr. Josselyn says nd
definite plan has been formulated.
Hays Bate Proportionately the Sains.
"Inasmuch as there appears to be a
desire in certain quarters to purposely
mislead the public In regard to prices
named In our bid for city lighting, we
think it proper to let the publio know
the exact f acta tn the- matter.
"The bldwe ave submitted to the
city doea not contemplate any Increase
whatever In the rate now charged for
lighting the streets of the city. The
rate proposed for Incandescent lighting
is on a little different basis thanbefore.
predicated upon meter measurement, so
that we will receive payment for exact
amount of current used. Instead of on
the basis of a flat rate, as heretofore;
and while it contemplates a little
greater gross compensation to us for
incandescent lighting, than under the
present contract, the amount is so small
that it ts not worthy of serious con
sideration. , "It is stated that our bid for city
lighting will, if accepted, cost the city
$15,000 per year more than at present.
This is absolutely false. The rate quoted
the city is no higher than at present,
the cost to the city being increased
only in proportion to the Increase in
number or lights used.
"We have also proposed that in the
event of the city dropping their contro
versy over our present bills for city
lighting (which, for the 10 months'
period covered would involve' approxi
mately $25,000) we will reduce the cost
of each arc lamp to the city $3.60 per
annum, and the .cost of incandescent
lighting one cent 'per kilowatt hour.
Declares Plan a Saving-.
"On the basis of the present number
of arc lamps installed, this would ef
fect a saving to the city of about $5,760
?er annum, or $27,800 for the five years,
f the increase in arc lamps is in like
proportion for the next five years to
that of the last five years, the saving
to the city for the five year period, bv
acceptance of our proposal, would ap
proximate $40,000. We have no fears
of the outcome of a suit against the city
for the fulfillment on its part of its
present contract with us for city light
ing; but would much rather have the
matter settled amicably and without
feeling or delay, in the manner indi
cated In our bid. . whereby the city
would save the $40,000 referred to.
"No official of this company haa been
authorized to state that we will not turn
off city lights on December 31. 1908,
if a new contract is not entered Into
with this company; no definite plan of
procedure in such an emergency has
been determined upon. We prefer to
let the future take care of Itself In that
particular.
"We have no desire whatever to profit
at the expense of the city., but to give
the city the best of every proposal, in
that we are more vitally Interested In
the welfare of the commonwealth than
possibly any other corporation, concern
or individual. As evidence of this, the
provialonal rates we have quoted the
city are the lowest made to any city,
of the same or greater size. In the en
tire United States.
