FATE WITH JURY
Family Feud Is Brought Out
by Evidence at Mur
der Trial,

Eugene, Or.. Nov. It. The trial of
Harry Tabor, charg-ed with manslaugh
ter by the grand Jury in the killing of
Harry Stuckey at Deadwood. in the
western end pt Lane county, October t,
was completed late yesterday afternoon
and the case went to the Jury last night
The taking of testimony consumed
almost two days. A large number of
witnesses were examined, mostly resi
dents, of the western end of the coun
ty, nearly all,. of whom were acquain
tances of Tabor and Btuckey.
The evidence brought out the story
of a feud that had existed between the
Stuckey and Tabor families for over
a year. It was shown that Stuckey had
created trouble among several families
side from Tabors. The trouble which
led up to his killing seems to have orig
inated from Stuckey acquaintance
with the wife of O. W. Stelnhauer.
Steinhauer made accusations against
Stuckey, and Tabor and his brother
Merle, according to the evidence, took
up the matter and expdsed Stuckey.
Thereupon Stuckey, It is alleged, swore
vengeance upon Harry Tabor, and the
evidence given at the trial shows that
he threatened to get" Tabor at Vari
ous times, going so far as to carry a
rifle to church a number of times In
the hope of rinding Tabor there, re-
marxing onoe tnat ne would "get" him
If he had to do it In church.
On the day of the shooting, according
io i no evidence, oiuoney ana nis wire
were going through Tabor's field on
their way to the postoffice to cash a
money order. Tabor saw them approach
ing and ordered them off. Stuckey said
something to the effect that Tabor
could put Mm off If he wanted to and
continued to approach Tabor. Tabor
swore on the witness-stand that Stuckey
reached In his pocket for his gun, but
that he (Tabor) was too quick for him.

feet away. Mrs. Stuckey said her hus
band made no attempt to draw his gun.
Thirty or 40 witnesses from the vicin
ity where the Stuckeye and Tabors live
testified as to the good character and
reputation of Tabor, while each one of
them stated that,, Stuckey's reputation
was bad and that he had a vicious tem

If counsel insists upon making personal
remarks, I suggest that the court ad
minister a little contempt medicine."

gling plot wag .thwarted, today when 10S

barrels supposed to contain cement

from China to Corregldor Island, and
the officials have renewed their activity
to discover opium in all shipments from
Chia. Tne; opium-was confiscated and
