F. J. Helliwell failed to get to the
Jury yesterday afternoon with his suit
for $1,000 damages egainsfheToTt
land Railway, Light & Power company,
'Judge, cieland granting a motion for
nonsuit after the plaintiffs evidence
had been submitted. Helliwell Is a
grocer at Kern Park, and was hit by a
car on the platform at that place last
February. The case went out of court
because several of his witnesses testi
fied that the motorman of the approach
ing car blew the whistle some dlatanoe
away from him. Helliwell testified that
he did not hear the warning, but his
other witnesses established the theory
of contributory negligence for the de
fense. The state board of dental examiners
yesterday finished Its work of examin
ing 27 applicants for licenses to prac
tice dentistry. Of tills number 23 re
ceived marks sufficiently high to entitle
them te the covetesllcenses and will be

Scotch day was observed, and the Idea
was carried out In decorations and re
freshments as well as In the Interest
ing program prepared by Mrs. Evelyne
Spencer. Miss Elizabeth Hoben opened
v the program with Scotch airs skillfully
rendered . on the piano: Mrs. Evelene
Spencer gave a delightful ScoUh mon
ologue; Claire Mqnteith sang a group of
Scotch songs to Miss Beatrice Hldden's
accompaniment. After the literary hour
- Scotoh cakes and -tear were served.

board meeting last evening the new fire
committee was erdered to find out why

Joseph Tiekey was found guilty of an
assault by a Jury in Judge Bronaugh's
department of the circuit court yester
day Jifitrnoon. He was accused of as
saulting Frank Ekart with a revolver
on August 14, but the evidence showed
that his fists were chiefly responsible,
lie will be sentenced next Tuesday
