It is known that the grand Jury la
Investigating thia allegation and that it
will base its findings upon the alleged
facts within a short time. This is shown
by the action of the grand Jury this
morning in presenting a hypothetical
question to Judge Ganteobeln. This
question was as follows:
Doe the grand Jury have Justifica
tion over an alleged conversion of
funds to connection with an alleged real
eitate .transaction thaf happened in
Washington that is, the real estate la
situated In Washington and the checks
were deposited In a Portland bank; the
parties owning the property originally

The court therefore Instructed the Jury
to pay no attention to any matters
which might have to do with that trans
action. It Is understood, however, that the
new charge against Boise has nothing
whatever to do with the Hawthorne es
tate or its business. The Vancouver
property was not included In the es
tate's holdings, but waa the Individual
and personal property of Mrs. Haw
thorne and the heirs. Irrespective of
any estate considerations. The alleged
embesslement of the 1 1.000 by Boise
therefore would not come under the
ruling of tho court regarding, tba Haw
thorne estate matter and can bo con
sidered by the present grand Jury. It
la suspected that Mr. Boise Is to be
called before tho grand Jury to explain
