He dwelt on Martin's drug habits, and
told the Jurors that men of their mature

Humors are current that the altmatory

tion 1T41 of th code and declared that
the atate a case la at variant with th
provisions of the statutes.
District Attnrnev Cameron anA rwn,.t-
Fltsaerald replied, the latter making the
chief argument. He said that th de
fena seemed to overlook tha point that
a man might premeditate a murder
when th raotlva waa robbery, and that
nartltlnn between the room. Where
great amount of blood was shed, and the
murderer aeiaed a rifle from the rack
close by. Wolff struck at the man. in
flicting the deep acar on Martin'a fore
head, an d breaking the handle of the
ax across the gun barrel, 'men ne was
struck down by the butt of the heavy
rifle in the handa of the murderer, who
onmnlcted hla bloody work with the
broken ax. boatlna and. hacking his Vic
tim's skull with It. He dragged the
body to the corner of the room and left
the bloody Instruments of the struggle
close by.
The anenVer remarked UDOn the acra.
eion of Martin's hands -between the
thumb and forefinger of each hand as a
corroboration of this tneory. xne mur
derer's hands were torn by the heavy
gun barrel while he waa gripping u in
his fight with Wolff, the prosecutor de
clared.
Bloody Evidences
The district attorney declared that the
Identification of the bloodv overcoat was
complete and convincing, and passed the
same opinion on tne crimson aiainea col
lar. He held ud the bloody ahlrt and
collar and pointed out that the blood.
on botn is centered at tne rrom oi me
neck, where Dr. Zelgler testified that
Martin waa aeverely out at the time of
the arrest.
Next came a comparison of the testi
mony, of Max Drey and Martin regard
ing the ahirta Ha asked the jurors if
they would believe that Drey came an
the way from Chicago to perjure him
self and say that Martin bought three
shirts, and that the bloody ahlrt was
one of them, if Martin in ract oougni
only one? He emphasized the corrobora
tlon of Drey on thla point by the clerk
In tha Solomon nawnshoD who overheard
conversation between Drey and Martin
about these shirts.
Mrs. Grub, said tba diatrict attorney,
is a friend of Martin, and haa tried to
administer to his diseased mind. The
speaker said the jury could have no
reason for disbelieving her, and must
believe her In preference to Martin when
she said that his face was not scratched
on April 30. V
If Waldy the logger saw. Martin with

cutor, It waa on the nlgVit of May 1, and
not April 30. Turning then for a mo
ment toward Mrs. Martin, who sat be
hind her husband, the diatrict attorney
aroused a vigorous protest from the de
fense by saying that he "wished that
little woman who haa aat all through
this trial, except during thia morning,
mlaht aDeak." He said he believed Mrs.
Martin remained away tn the morning
because she did not want to hear her
husband tell a atory that he knew waa
untrue, ,
Tha. apeaker declared that the Identi
fication of tha glove of Wolff found In

proaucea no proor or iu announced
theory 'that two or three men committed
the crime. if there wer two men,
Martin was on of them, and he knows
who the other is," aald Cameron.
The speaker aald that Martin waa not
the kind of man who would go home and
wait in the barn for hla wife to com
home. He la a man who drinks punches
and take cocaine and spends his money
around saloon, and a man of hia caliber
would not spend the evening In a barn.
Coming to the cravenett. tba district
attorney declared that it waa peculiar
that Martin triad to be rid of It whan
he learned th offlcera wera after him.
Tha Identification of thla coat aa Wolffs
was convincing, tha soeaJcer held, and
he naked why Martin had not tried that
coat on hefor tha Jury If It waa hi,
te abow that It fitted him And why did
he not also try on the collar and shirt,

uonciudin ma argument. Mr. Cam-
Seneca Fouts began apeaklng tot the
defense at 4:20 o'clock. He first touched
on the dangers of circumstantial evl
dance, declaring that there are numerous
lnatancea of miscarriages of Justice re
sulting from it. He hoped that the men
on tne present lurv would nave occa
sion to say in their after life, "I did not
convict on circumstantial evidence and
hantr an Innocent man.
Mr. Fouts continued by calling- atten
tlon to Martin's attainments and said It
would be conceded that he Is a man of
Intelligence. He asked whether a man
of such intelligence would be foolish
enough to stay around town for several
days with Wolff's overcoat and gloves
in his possession. Only a fool would
have done that, he aald.
The attorney made an attack on the
credibility of Max Drey, and said his
interest in the conviction of Martin
was shown by the fact that he came all
the -way from Chicago to testify against
the defendant, although he did not have
to come. Drey came, he said, because
Drey and Wolff were both Shylocks.
and Drey feared that if a victim Is not
made of some one there might be an
enldemlo of murders of Jew peddlers
similar to the one in Chicago a few
years ago.
Fouts had spoken about 80 minutes
when court adjourned for the day.
