Wood Preserving company, which con
tends that the cltv entered Into a con
tract with It bv which they were to re
ceive this compensation - for . the - im
provement of Alhlna ' avenue between
Page and River streets.
The improvement . was made in 1904
and -some trouble has already been
brought about over tne refusal of the
property-owners along the street to pay
the assessment which the city levied. .

and by Mrs. Grub and bears the same
peculiar-fault that tne hammer will not
reach the cartridges. According to the
story of the defense the gun was
pawned by Joseph Lundy at the aecond
hand store of W. O. Howard, on May 6.
Lundy haa been round by-tne aetsnse
and is retained aa a witness for the
defense. He saya that lie bought the
gun of a chance acquaintance who. in
turn, bought it, according to ine story
told Lundy. of a man who was "half
shot." This tallies with the story told
bv Martin of hla having sold the weap
