less the boys are all enthusiastic over

finished his argument before Judge W.
P. Lawler In the hearing of charges
made by Ruef against Detective Wil
liam J. Burns ot the graft prosecution,
accusing him of contempt of court and
tampering with prospective Jurors In
one of the grand trials. The matter
was submitted to tho court and a decis
ion Is expected tomorrow.
Attorney Francis J. Heney, In his con
cluding remark, defending Burnt, sun
ported tho right of the prosecution In
any action to ascertain the character of
men likely to be drawn upon Jury pan
els. He asserted that half the total In
dictments throughout the country failed
of their object on account of the Jury
system, bv which Jurors could be de
based with bribe monev offered by
Wealthy corporations. Heney declared:
"Tho public Is being preyed upon from
above by the public aervice corporations
and from below by the saloon and dive
keepers, of w hom there are so many on

tho new theatrical trust. Is In Portland
today and confirmed the New York dis
patches which said that Klaw & Br
lungor and Beck Intended corralling all
the theatres In the I'nlted States Into
A 1600,000 trust. Matters connected
with the organization of this merger
have kept Mr. Heck from being In Port
land for the opening of his new thea
tre here,
"There are so many theatres In the
country," said Mr. Hray, "that It Is hard
for any or them to make a living At
present any tlmo a bunch of men decide
they want a theatre In a city they sub
scribe the money, get It two-thirds built,
and then begin to look around to put
some attractions In It. Then tho,- find
that Klaw & Krlanger have all the high
priced attractions, that the Orpheum
leoplo aro In with their vaudeville and
hat they are left out In the cold, with
their big house on their hands. If this
house only hurt them we wouldn't In
terfere but we find It forms a constant
menace to our houses, so wo propose to
keep out as many of these people as we
can.

Indirect victors In a decision handed
down today by the United States court
of appeals denying the claims of tho
Imrkee estate against the I'nlon Pacific
railroad. The suit, which involved mil
lions of dollars, had been pending five

John A Kuykendall, as administrator
or the estate or Charles Ourkee, who
died in 1HT0, sued I lie Union Pacific
railroad, claiming that Durkee owned
$'::. (ilia. hoc worth of Union Pacific first
mortgage bonds obtained by lending
money for the construction or the rail
road. Kuykendall claimed that through the
manipulation of other stockholders the
estatu was defrauded out of Its rights.
The suit was originally brought In
Salt Lake, where Kuvkendall lost. To
day's decision upholds the first decision.

Seattle. Aug. 12. Although tho nom
ination of officers for next year Is on
the program at the convention of the
Fraternal Order of Eagles today It Is
very Improbable that this order of busi
ness will he reached until late thl3
afternoon, If at all.
This morning. In order to hasten the
work, the convention was called to or
der at K:30 Instead of 10 o'clock. The
reports of the grand secretary and
treasurer were read and adopted.
Grand Worthy President Bell made
his report, which consisted of about
5.000 words. He referred to the great
work or tho order, mentioning especially
the' aid given during the Monongah mine
explosion and the great fire which
swept the city of Chelsea. He showed
that tha order has enlisted SS.K.H new
members during tho past year. Mr.
Bell's report was adopted.
Tha grand trustees and finance com
mittee presented reports. These were
discussed and will be approved possibly
ths afternoon.

The Meadows, the convention will bo In
session this afternoon.
The committee on organization of
state aeries asked fjf further time and
this matter was debited at length on
the floor of the convention. Practically

nounced that nominating speeches will
be limited to five minutes and seconding
speeenes to three minutes.
Saratoga, Omaha, St. Louis, St. Paul
and Atlantic City delegates are busy
securing pledges for the convention next
year but so far little advantage is perceptible.

of a pet cat came to light In this city
recently In Hempstead. L. I., when Cor- ;

of the body of Mrs. Jane Trumbull.

ever was a crime committed, it was
committed in tho management of the af
fairs of the Market Street bank. 1 have
laid sufficient evidence before the li.s
trlct attorney to warrant criminal ac
tion being taken. I will not state whom
I think culpable, but I believe 'resident
Hartell was not Intentionally implicated
In crooked work."
This statement was made today by
Receiver L. H. Mooser of the. Market
Street bank, which failed last winter,
and which has been a storm renter for
the past few weeks.
Tho grand Jury met this afternoon to
consider the evidence laid before ins
truct Attorney Uangdon by Receiver
Mooser.
President A. F. Martell has made a
statement of the whole affair to Dis
trict Attorney Iangilon and It Is under
stood that he will be granted Immunity
from prosecution as was -Vresldent
Walker of the defunct California Safe
Deposit & Trust company. Martell has I
offered to deed his house and all his
firoperty to the bank to make good tho
oss so far as he Is able. i
Former Cashier W. II Nusli of the '
defunot bank has refused to deal with,
the district attorney's office. He has
employed an attorney and will stand by
his guns.
The countv officials who hav-en i
probing the affairs of the wrecked bank
allege that certain funds of the deposit
ors were used by some of the bank offi
cials to float a realty scheme.

When the physician arrived he was
compelled to administer an opiate. Af
terward the woman said she felt easier,
yet she complained every now and then
of sharp pains in her limbs. She slept
only a few minutes Sunday night, and
the dawning of Monday found her In
convulsions.
Trumbull summoned neighbors to at- 1
tend his wife, pending the arrival of;
lr. Fletcher, from Freeport. By the!
time the physician got there Mrs. Tnim- '
bull was foaming at the, mouth, grind- -inn
her teeth and. It Is said, every little
while uttering a noise tike an angry cat. j
She was a Tig woman, weighing near- i
