Fresno. Cal., July 8. Unless Orove
Rogers implicates him In the kidnaping
of beautiful Edna Doinehglne. Tony
Ixiyeull. under arrest hois charged with
complicity In the crime, may escape con
viction. It was learned today4lmt the
stolen girl, upon whom tho prosecution
relied to Identify RotlVt s" companion,
did, not see hla face. Miss Dom-
onglrie authorized Mrs. R.'L. Peeler, to
whose homo she was taken after the
sensational rescue, to make a statement
for her. Mrs. Peeler said:
Edna does not know anvthlng about
the men who carried her away from
home. One of them left her as Boon
as they reached Coalinga at 3 o'clock
In the morning. It was still dark and!
as ho wore a mask and did not speak
sue would not be able to rooognlito him
ngntn If she saw htm. She ways she
would Hot even recognize Rogers again,
as he kept his mask on throughout the
day und spoke but a few words."
Loveall today occupies a cell in the
same prison where Rogers in confined
but tho men will not be allowed to see
each other until they are taken Into
court for trial. It Is hoped Rogers may
he induced to Implicate Loveall if they
are kept apurt. Rogers Is the only wit
ness, so, tar ns tho authorities know,
who villi be able to connect Loveall
with the case.
When Loveall was placed in a cell here
last night he vehemently protested his
Innocence and today he asserted that his
arrest was n serious mistake. He -said
he was asked to Join the posses which
were searching for Miss 1 otrHHtt(iu and
her captors, ami did so. At the Roberts
ranch he learned that he was suspected
of complicity In the crime and was
warned by friends that he had better
make his escape. He was willing to
give himself up, lie says, but his friends
were afraid the angry mob might shoot
or lynch him without giving him a
chance to prove his innocence.
Miss Iioinenglne will go to Santa Cruz
tomorrow, where she will spend the
summer, recovering from the nervous
shock which follows her terrible ordeal.
Preliminary healing will be granted
Flowers and Lovonll sorue time next
week. The case will come to trial in

After a spirited fight in the health
and police committee meeting" this morn
ing, the members of the board returned
two reports on the Nottingham matter,
one, a majority report, favoring Senator
Nottingham and allowing .his frame
building to remain within ijie fire lim
its and the other, a minority report, ad
voeHlIng the repeal of the permit for
the building and the destruction of the
ne.i rl y.-c,,inpleted structure.
Headed by President C. A. P.lgelow
of tlie East K,id Husiuess Men's e,ub
a commit! too of east side business men
and property-owners appealed and
asked that the Nottingham building be
torn dovn. Mr. Higelow said that he
had been discussing the recent increase
I In fire insurance rates with the Insur
j anon companies, and they told him one j
of the reasons for raising rates was !
that the fire limits are not largo enough.
CotineMiiiari Cone'atinon favored tearing
! dowti the building, as did Riiildlng In
i spector Dobson. who notified Nottiug
I ham that lie was breaking the law sev
, era I times before the building was be
gun, and while It was in process of
construction.
1 'oiin, II man Wills, former .City Attor
ney MoNary and Councilman Ifftker of j
the Raker theatre all spoke In favor of!
allowing the frame building to stand, I
(saving that the council had issued a!
I permit for its construction within the;
J tire limits and therefore It had no right ;
j to say tiiat It should lie torn down now. j
I The building commissioner said he
had norl-fied the council that the city
j attorney held the erection of the hulhi-l
lug and the p.usnge of a permit fori
sii'h ere-tlon as Illegal.
I Councilman Wills, who has favored
, Not 1 1 n;,-iia m all tl.roujli tlie emitro-i
j versy, said that tho building inspector i
I should have given tlie council a writ- i
j ten opinion to this effect, and as he -
did not. lie considered tlie I, lame for the-i
I whole affair lay on Mr. Dobson's shoul-I
ders In spite of tho fact that Dohson j
has been the one to lead the fight !
j against the frame buildings all along j
, Councilman "Annsnd cnficurrv.il and they,
rent a report in against intei ferlnfr with
j tho building. Mr', Concannon returned'
a minority report and said he would)
carry the fight Into the council. I
