' Burkhart testified that tha wages of

ies sustained by being shot by the po
liceman and also the amount of fels

The complainant asserta that ha was
unlawfully shot, arrested 'and hand
cuffed. Th trouble occurred early on
the morning of November i at Tenth
and . Morrison gtreets. Burkhart had
been but with friends. It seems; and
when he arrived at' home fbout o'clock
in the morning his wife remonstrated
with him and finally lefV tha room.
He followed her and then the police
man interfered. c,
While Suitter was telephoning for
the patro wagon, Burkhart broke and
ran away. The policeman followed hot
toot and began firing, One ahot took
effect
' Counsel for the defendant mad a
motion that tha case be dismissed on
the ground that 'fedora! court ag
no Jurisdiction In the hearing and set
ting forth ' that - Burkhart ' had' never
voted, paid,, taxes or owned property in
Minnesota. In tha complaint Burkhart

sota and owing to this is entitled to a
trial in the United States court.
