HIGHER BIDDER
GETS CONTRACT
Court Will Be Asked to Fix
Status of Daily Guide, :.

action the council adjourned until to
morrow morning at 9:80 o'clock, when

. The Guide and the Abstrect were tho
two lowest bidders, the Guide being a
; fraction of a cent a line lower than the
- Abstract. City Attorney John P. Kava
naugh has given an opinion that the
Guide is not a boriaflds newspaper and
the councilman followed his advice nd
' refused to' award the Guide the con
tract; although , the charter provide
that the-award shall go to the lowest
.responsible bidder. The time for enter-

ing expires June 1, next Monday, and
. immediate action has to be taken. . -
The owners of the Guide contend that
their publication is a bonaflde newe-

If the matter cannot be decided to the
satisfaction of the counellmen and city
' authorities the council has the power

i ter will be finally disposed of. The
charter provision follows; -
"Section 6. If the city official news
paper ceases to be published, or If for
any cause -tho contraot be annulled, a
new contract for the unexpired term of
the original contract shall be let to the
lowest responsible bidder publishing a
dally newspaper as provided In this
charter, and until such new contract
, Is let the council shall designate a
dally newspaper in which all advertis
ing shall be published, which newspa
per shall be known and designated, for
the time bolng. as the city official
newspaper." -v . i -

' At a meeting of the city civil service
commission this morning, B. H. Barrett
who recently took the examination for
-sewer inspector, . asked the members to
re-marx his papers ana Quainy nun as
an inspector. According to the first
morklna-s of the Doners Barrett failed
to pass and asked for a review of his
work. Thinking that perhaps a clerical
error had been made In Barrett's raae
the. commission ordered a re-marklng
with the result that the same grado
was returned. Barrett was not satle
fled and asked the board this morning
to overrule the grading and allow him
to qualify. The ooard refused to grant
tne request., -
The weather bureau this morning Is
sued Its. monthly bulletin of data con
cerning weather conditions for tho
month of June, deducted from 17 years
of observations. The - highest June
temeerature ever recorded here Is 99
degrees. That occurred in 1871, and
1904. Tho lowest temperature -ever
known here in June is 19 degrees, re
