.Because the Portland Hallway, Light
' Jc Power company failed to fumigate
one of It streetsears upon an order
from Health Officer Dr. Bather C. Pohl
the car was seised at Sixth and Wash
ington streets yesterday afternoon by
Detective Tlchenor and taken , to the
car barns and fumigated. The motor
man' R. W. Mllla. In whose home at
Twenty-second and Thurman streets a
case of smallpox exists, was also fumi-
gated, after which the car was again
allowed to go into commission. Dr.
Pohl 'Issued an order to have the car
fumigated yesterday morning and when
Dr. H. C. Parker, deputy, learned that
the order had not been obeyed and that
the car was in commission he notified
the police and the seizure followed. L
. The -council postponed action on the
revocation of the. permit of the Port
land 'Railway, Light ft Power company
on Killings worth avenue from IJnion to
Williams avenues until the first meet
ing In June. The council ; was petl-
tioned some time ago to have the com
pany Uher tear up the single track on
Xllllngsworth r avenue or put down
double tracks, and an ordinance was In
troduced revoking the permit. Repre
sentatives ot the electrlo- company
asked that the matter be put over until
It could determine Its course. The
street la about , to be paved and the
property-owners are anxious to have
the track question settled before the
pavement ia put down.

Formal notice of appeal has been
given by attorneys for the defendant in
the test case over the vehicle tax. In
volving the question of right to invoke
the referendum on measures passed by
the city council. In passing on a de
murrer to the complaint in the case of
George-Long against the' city of Port
land,, Presiding Judge Oantenbeln de
cided that the referendum oannot be
applied until the city charter is amend
ed. Aa the matter now-stands,-with an
appeal pending, the vehicle tax cannot
be collected by the city until the mat
ter is Anally passed on by the supreme
court. .

Governor Chanrherlatn will- deliver
the address ot the 'day at the dedication
of the new orphanage for girls at Os
wego, July 4. ArcTiblshop Christie will
' have charge, of the dedicatory ceremo
nies. A musical program will also be
given by the Sisters of the Holy
Names. Father H. J, McDevltt, of the
Cathedral, Is making arrangements, for
the opening exercises and for the bene
fit of the many people who will want
to go to Oswego from Portland will
probably charter a steamer to take the
crowd to that place.
One hundred and fifty dollars Is all
that a Jury in Judge Cleland's depart
ment of the circuit court was willing
to allow Charles Lelner in his damage
suit against L. M. Holbrook and wife,
on ' trial yesterday. Lelner asked for
8H.S46. claiming that he had not been al
lowed ' to' occupy store room he had
leased from the defendant in the Hol
brook block, St. Johns, and that he had
suffered heavy loss through the pur
chase of stock that he was prevented
from placing on sale.
An ordinance that will probably meet
with Mayor Lane's veto axe was passed
hy the council yesterday afternoon, ap
propriating $500 for decorations on the
east side during the Rose Festival. The
ordinance was originally drawn to take
the money out of the council's special
11,000 fund, but was afterwards amend
ed so as to take the appropriation out
of the "general fund. Inasmuch ss the
city's ' funds sare low, it is considered
probable that Mayor Lane wilt veto the
measure.
The (-year-old daughter of A. Blck
nell, 220 East Thirtieth street, was yesterday-
afternoon 1 - severely Injured by
being run over by a. bicycle ridden by
Walter Lynch. 269 Twenty-ninth street.
The little girl was playing on the side
walk when the rider came along at a
fairly rapid speed, and before the child
had time -to escape she was struck and
thrown prostrate. There ware no bones
broken. Mr. Blcknell will trot prosecute
the case.

pleaded guilty In Judge . Cameron's
court this morning, to a charge of gam
bling. They were , shaking dice for
drinks in a saloon at the corner of
Sixth and Stark streets when Patrol
man Hamea, arrested them. The case
was continued for sentence.
The Central W. C. T.,JJ. held a busi
ness meeting Wednesday afternoon, at
which several' matters were discussed.
Afterward Mrs. M. Christian conducted
a parliamentary drill In a very interest
- ing manner, and was requested to con
tinue the subject next week. f
The city council yesterday passed an
ordinance allowing druggists to sell
liquor for medical purposes uppn a pre
scription from a physician without pay
ing a license.' All druggists who sell
Jlquor -in quantities must pay , the reg
ular retail liquor license of (800. ,
. Water through hose for sprinkling
yards or sidewalks or washing porches
or windows must be paid for in advance
and used only between the hours of 4
and 8 a. m. and 6 and 9 p. m. It must
not be -used for sprinkling streets. If
used contrary. to these rules r waste
fully it will be shut off.
Jacob T. Oove, the well known as
nayer of Portland, died yesterday of
paralysis at his home, 440 East Fif
teenth street Mr. Gove hal lived in
Portland since 1880,' coming here from
Belt Lake City. "The f uneral will be
held at the crematorium today. -

been assessed by viewers for th pro
posed opening of Grand avenue. Pad
rick's communicatiou was cleverly writ
ten and caused much laughter. Padrick
said the viewing was not done properly,
and set out at length the manner In
which the viewers boarded a streetcar
made a hasty trip to the proposed im
provement, smoked many cigars, glanced
at the property to- be assessed, esti
mated how much the property owner
oould stand and then hurried back to
the streetoar to return to the city. Pad
