Mr. Cotton's line of defense was out
lined several days ago in The Journal,'
and he has carried It to a point, that
will raise In the federal court for Ore-
ton the entire lmt of questions that
have been raised by railroad counsel In

the popular movement to regulate rail-

Mr. Cotton further alleges . that the
act creating the Oregon railroad com
mission is in conflict with the federal
constitution for the reason that It seeks
to arm the commission with adminis
trative, Judicial and t legislative func
tions, each of which the federal Jaw
prescribes shall be divided and Invested
in separate bodies or persons. He says
the O. Ri-fe N.-company-Is -a part of
the Union Paclfio system.' and that 7
per cent of Its business is the hauling
of freight from the 'Missouri river or
points east or south to Portland, and
that the distribution of this freight
from Portland - to. ioints' within the
state of Oregon is a function the charge
for-which is baaed on the Interstate
rates charged for the Jong hauL Any
reduction of these distributive rates by
the Oregon railroad commission amounts
to an attempt to ' regttfate commerce
between the several states and is an
Infringement upon the exclusive powers
of the federal Govern m en t. ,
Judge Wolverton will, after looking
over the netltlon and conferring with
Attorney-General Crawford, fix a date
for the hearing of the railroad com.
