IN DAMAGE SUIT
Judge Bronaugh In the circuit court
thla morning gave Judgment for the de
fendant In tha damage case of Jake An
drew agalnat the Portland Wire and
Iron company. Andrew waa struck on
the head by a heavy atlck aa he waa
passing near a fire escape on the De
kum building. The work of putting up
the fire escape waa done by the defend
ant, and had practically been completed
when Andrew was Injured.
The workmen denied that they had
ever aeen the atlck, though It had the
appearance of having been uaed around
iron work. Judge Bronaugh aald that
to find for the plaintiff he would have
to presume that the stick waa in pos
session of the oompany and alao to
presume that It fell to the ground
through the company'e negligence, and
thla double nresumDtlon he could not
support. The evidence failed to show
where the stick came from, and aa the
building waa full of tenanta it might
have been thrown out of a window,
aald the court.
