. The ordinance provides that the com-

airbrakes by January 1, 1909. and the
evmrany asked that the measure be not
l-asaed berane It Is Installing airbrakes
- as rapidly aa It can. The majority
party acquiesced ,to the company s re
iueat. . ,Not so Vaughn. Ho announced when
the measure was placed upon the table
the lie would call It up at every coun
cil meeting: until the council had either
varaed it or killed It. tie has kept his
promts and yesterday again spoke In
favor of the measure. Vaughn referred
to the recent death of Fansher, who
fcas killed by a car and said tbat while
lie did-not know positively, he did not
ubt that If the car had been equipped
with airbrakea the man would be living
today.
. ; , Tangha Xahes Council.
-Vaughn said "he did not believe In
risking fish of one and flesh of an
other." and that the council should mete
ut the same kind of legislation to a
erporatlon that It would to an Indlvld
tinl. lie said the council requires the
tcanut peddler to move on from one
llock to snot her but when It comes to a
corporation like the Portland Railway,
Light A Power company with millions
of dollars behind it, the members not I
only did nor compel the company to
"move on In putting on airbrakes on
its cars, Dut allowed a measure arrect

"A. O. Rushlight, 'councilman of
Seventh ward, has followed his
the
Inten
tions to become a candidate for the
nomination of county assessor on the
Republican ticket. Mr. Rushlight has
mads a good record for himself In the
city council. His platform Is as fol
lows: - ,
during my term of office exercise the
functions thereof for the best Interests
of the county and the taxpayers there
of. I shall favor a strict business ad
ministration Irrespective of any per
son, corporation- -or - other Interest
whether political or otherwise; I shall
endeavor to make a Just and equhable
assessment of all property within the
county. Words to be printed on bal
let: ''Honest and Just assessment with
out fear or favor.' I
reolied to Vaughn
and said thst the reason he did not
rote to out the measure on final pas
sage was becauae the comnany was ex
ercislng good faith In placing airbrakea
on its cara.
Councilman Cottel gave the expert
testimony of the rtvbatn and said he had
attended the comnetr's Inquest over Fan
aher's remains and mind that startling
conditions existed, iie said the testi
mony of one wltnesa was to ths effect
that the car was going at the rate of
but four or five miles an hour, lie said
that according to this witness Fansher
hod oecn struck by tne car and dragged
20 feet Cot t el pointed out that had
the car been equipped with airbrakes. It
could have been stopped almoat In
stantly.
JTo Answer to Cotters Speech.
The councilman explained that an
other witness testified that h had
stepped off the distance from the place
where Fansher had been struck to the
filace where the car was stopped and
ound the distance to be 41 feet This
was considered to be greatly in excess
of a reasonable distance for stopping
a car moving so slowly aa the one that
killed Ksnsher.
Further explanation elicited the Infor
mation that the motorman was Inexpert
enced and did "not thoroughly under
stand the operation of the lever brakes
with which the csr was equipped. Dr.
CotttIisuid that If the car had been
equipped with air brakes the motor-
man, although Inexperienced, could have
stopped the car in ft few feet and prob
ably saved the man a life.
There was no reply to Dr. Cotter
speech. i

Councilman Baker attempted to re
move the sting of Concannon's remark
by Insinuating that Concannon had been
guilty of neglect of duty. Baker arose
and said sarcastically to Concannon:
"I at least represent my ward. Mr.
Concannon. Now I am compelled to
