Three Counties Make Too

Salem, March 18. The circuit court
docket of this district has' become so
congested that unless the number of
suits filed In the future diminishes to
a t considerable extent or the circuit
judge of some other district can come
to the assistance of Judge Galloway, it
Is doubtful If the majority of the cases
begun can be heard before several
months at the earliest.
Judge Galloway of the equity depart
ment of the circuit court, after sitting
for five weeks almost consecutively In
this county, has nearly 150 open cases
still on hi docket. This same number
of cases were on his dookct when he
pMheiran his present term five weeks ago,

than 100, the number remains tun

loway Is compelled to go to Linn coun'
ty next Monday and begin the bearlna
of some ISO cases, which have startec
there since his last sitting. In the
meanwhile, Tillamook county cases
have aggregated a larger number than
ever before, there being between 76 and
100 cases held up there, with more suits
forming a steadily incoming stream.
Judge Galloway will be unable to go
to Tillamook county until April 20. ,and
by that time if legal troubles increase
at their present rate tne proDaouiuea
are there will be in the neighborhood
of 100 untried cases in this county and
160 in Tillamook.
Yamhill county attorneys are also
complaining of cases being held up for
trial, but Judge Galloway will not be
able to repair to that county until
April 13. and it is doubtful if even then
he will be able to hear all of the cases
awaiting him there.
Polk county alone falls ' to add its
quota of- complaints for there Is but the
usual small number of 'suits to be heard
there.
Judffe Burnett Busy.
Judge Burnett of department No. 1,
the criminal department of this dis
trict, has on several occasions come to
the rescue of Judge Galloway, but that
department has considerable work it
self at present '
The work for the equity department
of the circuit .court is destined to be
on the increase instead oi Decoming ,
lens, owing to the aDDeals which are
beginning to be made from the railroad
commission in accordance with law. In
addition to these, the great majority oi
suits against state officials are begun
In the circuit court in this district, and
these cases take a great deal or lime,
usually take several days in succession,
such as the Dunbar and Klncald cases
now pending.
LAND OFFICE GIVES
FOREST SERVICE BIFF

Silver Lake. Or.. March 18. The con
tests arising from the recent opening
nf lamia in the HI r-a.n country, which re'
suited in ro much confusion, and dis
appointment to land and nomeseeaero,
have in nearly every case gone against
the homesteader and in favor of the
timber locator, on the ground that the
claims were unsuited to the require
ments of the homestead laws and were
nurelv timber propositions. Hence the
homesteaders are relinquishing and ril
ing timber claims instead.
Thla la the land that was temporarily
reopened for settlement last September
as unsuited to forestry purposes, but
suitable for settlement and upon which
niiatters were given SO days for mak
ing good on homesteads previous to the
ruing gate. -
WELLS-FARGO REFUSES
TO PAY IN DOUGLAS
Roseburs. Or.. March 18. The Wells-
Fargo Express, company has refused to
pay the taxes levied upon its property
In this county because the tax hereto
fore has been but about S8.60. while this
year it is tuo. it naa is oxrices in
this county, of which Roseburg is the
lamest, and the authorltiea believe the
amount of business' transacted by the
company and its assessable property
amply justify the assessment that As

RAILROAD; OFFICIALS
TO BE PROSECUTED

prosecutions of officers of the Chesa-
eake at onto roaa were rorecaptea to
8T in a report made by the Interstate
commerce commission following an ex
tensive hearing at Richmond, Virginia.
The report charges that for years the
road has been favoring certain grain and
packing house snippers by means or is
suing bogus transfer slips. i

Judge Galloway Continues

Salem. March 18. The circuit court.
Judge Galloway presiding, adjourned to
day in respect to the late Judge Thomas
G. Hailey at the unanimous request of
thenar association of this city.
The case of the state against ex-Secretary
of State F. I. Dunbar to recover
nearly 8100,000 claimed to have been il
legally collected, was continued until
9 o clock tomorrow morning.
Develooments of an exciting nature
may take place when court opens up,
Dunbar having been ordered to appear
at that time and show cause and pro
duce his private memorandum books, in
which were reoorded the fees he took
while in office. At the close of the
last hearing It was understood he would
fall to appear, and his attorneys would
appeal under a bond to the supreme
court

nreme court has upheld the constitution
ality of the law of this state which
makes invalid oral contracts for the
payment of commissions for the sale of
real estate.
